Meeting called to order at 7: 35 P .M. by Chun. Moore ROLL CALL PRESENT: Corrms. DeBellis, Merrill, Toth, Williams, Chrm. Moore ABSENT: Conrns . Cutler, Ebey AI.SO PRESENT: Laurie Duke, Staff Liaison Corrms. Cutler and Ebey had excused absences from this ~eting. Corrm. Merrill was appointed Ac.ting Secretary. APPROVAL OF MINUI'ES Motion by Conm. DeBe.llis , seconded by Corrm. ~rrill, to approve the May 17, 1982 minutes with the following aIIEil.drrEnt: Page 2, Para. 5, arr:end to read that the conference room is part of the Savings and loans building which is located· in the Alpha Beta Shopping Center. No objections. So ordered. APPROVAL OF RESOLUTIONS 1:-btion by Cornn. DeBellis, seconded by Coom. Merrill, to approve Resolution BZA 154-337. No objections. So ordered. 1:-btion by Coom. Merrill, seconded by Cornn. Toth, to approve Resolution BZA 154-455. No objections. So ordered. CONSENT CALENDAR Cbrnn. Merrill read the following items to be approved under the Consent Calendar: HB 82-015 -Implenenting a Connercial Planned Developll'.Eilt Overlay Zone HB 82-017 -Senior Citizen Single Family Residence (as second unit) in R-1 zone Cornn. Merrill pulled HB 82-015 from the c:onsent Calendar. Corrm. Williams pulled HB 82-017 from the C,an.sent Calendar. BOARD OF ZONING ADJUS'lMENTS MINUTES -June 7, 1982 CONSENT CALENDAR (Cont.) Crum. Moore stated that the above two items would be heard under Reviews. PUBLIC HF.ARINGS VARIANCE BZA 154-461 -20 17th Street Applicant: Mr. Richard Harn Page 2 Mrs. Duke gave staff report. She stated that the property was located in the R-2B zone, rrediun density residential. The existing and proposed lot density was 22 du/ac, and the existing and proposed lot coverage was approximately 53%. 'lhe eristing floor area was 1706 sq. ft., and the proposed addition was 160 sq. ft. Toe lot size was irregular, and the lot area was approximately 3936 sq. ft. She stated that the applicant was requesting pennissian to add 160 sq. ft. at the second story level over an existing den in order to enlarge a bathrrom and provide storage space for the master bedroom. She noted that the building has a "O" west sideyard (at Beach Drive) where the den is located, and the ad.di tion was proposed to maintain the smre setback. She stated that she made an interior inspection of the premises on May 2 7, and the floor plan of the existing building was found to be in confonnance with plans submitted. Coom. Toth asked if the applicant submitted Findings. Mrs. Duke replied in the negative, adding that she was not certain if he were asked to subrni. t Findings . Conm. Williams asked why the applicant was applying for a variance since his proposed additioo is under 10%. Mrs. Duke replied that the applicant was asking to maintain a O' setback cm Beach Drive for the 160 sq. ft. addition. She stated that a variance is needed if there is not at least a three-foot sideyard setback for the addition. Conm. Williams asked if both units were calculated to arrive at 22 du/ac for the existing and proposed lot density. Mrs. Duke replied in the affinnative. Public Hearing opened at 7 :50 P .M. Richard Ham, 20 17th Street, Henrosa Beach, applicant, stated that he wished to rerrodel the master bedroom and bathroom. No one appeared to speak in favor of the variance. No one appeared to speak in opposition to the variance. Public Hearing closed at 7:54 P.M. Corrm. Toth stated that he would like to be supplied with addresses of other properties in the zone that have s:unilar rights (addressing Finding No. 2) . Cornn. Merrill noted his familiarity with the neighborhood, and he stated that many properties in that area enjoy that right. Cornn. DeBellis stated that the residents at 30 17th Street have a 0' setback. Cornn. Toth noted that it should be required that the applicants provide the Board with Findings . Mrs. Duke stated that the applic.ants are routinely asked to provide the Findings. Motion by Comn. Cutler, Ebey Required Findings: Page 3 1. . . . because the building is alm:Jst 60 years old; the space is of an important nature to the use of the building. 2 .... because a O' setback seems prevalent on Beach Drive; the armunt of density on the applicant's lot is below the prevailing lot density of many of the areas of the City; the applicant is not adding to the footprint or to the dwelling units per acre; this variance would be required to make a reasonable upgrade of the second story. 3 .... because no one spoke or submitted petitions in opposition to the variance; the location of the addi tian would not cause impingenent of light or air to adjacent buildings in an appreciable way; it does not adjoin other property to the west. 4. . .. because it does not affect the general plan. She stated that the property was located in the R-1 zone, lO"vv density residential. 'To.e lot size is 50 x 100, and the lot area is 5, 000 sq. ft. The existing and proposed lot density is 8. 71 du/ac. 'lhe existing floor area is 1200 sq. ft., and the proposed acldition is 1030 sq. ft. The existing lot coverage is 40%, and the proposed lot coverage is 49%. She stated that the applicant was requesting permission to add nore than 40% to a single family dwelling with an existing nonconforming westerly sideyard setback of 3' 6" in lieu of the 5 ' required, and to provide a 4' 611 west sideyard with the addition. She inforrred the Board that an interior inspection of the premises was made by the Building Depart:m=nt on May 26, and the floor plan of the eristing residence was found to be in confotmance with plans submitted. Public Hearing opened at 8:02 P.M. Larry Heiller, 580 21st Street, Henrosa Beach, applicant, submitted a photograph of a property which ·also has a narrow sideyard. He stated that he needed the extra 6'' for a walkway near the nursery. He noted that the existing house is too small for his needs; therefore, he proposed adding a bedroom and a bathroom. No one spoke in favor of the proposed variance. No one spoke in opposition to the proposed variance. Public Hearing closed at 8:04 P.M. Motion by Comn. Toth, seconded by Conrn. Merrill, to approve the applicant's submitted Findings with the following aIIEndualts: Condition No. 1, add, "The building is a two-bedroom, den, one-bathroom hone which was built in 1951 and predates existing Code':'; Condition No. 3, delete the last sentence. She stated that the property was located in the R-1 zone, low density residential. 'lhe existing and proposed lot density was 10 du/ac. 'lhe existing lot coverage was 29.84%, and the proposed lot coverage was 45. 88%. The lot size is 45 x 95 , and the lot area is 4275 sq. ft. llie existing floor area is 1258.5 sq. ft., and the proposed addition is 683 sq. ft. She stated that the applicants were requesting permission to add rrore than 40% to an existing single _ family residence with a nonconforming 2'4" east sideyard and to maintain the nonconformity with the addition. She noted that the request to enlarge the garage and maintain the nonconfonning sideyard appeared to be a reasonable request; however, staff had difficulty finding justification for continuing the nonconfonning setback with the extension of the living quarters at the rear. She stated that she made an interior inspection earlier that day, and the floor plan was found to be in conformance with plans submitted. Public Hearing opened at 8:08 P.M. Jim I.eibscher, 572 18th Street, Herroosa Beach, applicant, introduced his wife to the Board. He submitted signatures from surrounding neighbors in favor of granting the variance. Mrs. Leibscher stated that the exceptional and extraordinary circmnstances was that the house was built many years ago with reduced sideyards on both sides . Also, a number of properties in the i.n:nEdiate area have similar reduced setbacks with additions. She noted that the lots are very small and are situated close to the street. She stated that they wished to extend along the established setback, which will not increase the nonconfonnity. She noted that the house is built as a single-family unit, and the use will not change. No one spoke in favor of granting the variance. No one spoke in opposition to granting the variance. Public Hearing closed at 8:20 P.M. BOARD OF ZONING ADJUSTMENTS -June 7, 1982 Page 6 VARIANCE BZA 154-463 -572 18th Street (Cant.) Chrm. Moore felt that the variance was a large request. He felt that there were other alternatives that could be explored. Corrm. Toth felt as though there were plenty of room for fire safety. He felt as though a second.,.-story addition would impinge on the neighbor' s light and air. Motion by COilIII. Merrill, seconded by Comn. Toth, to approve Variance B.Z.A. 154-463, as submitted. AYES: NOES: Corrms. DeBellis, Merrill, Toth, Williams Clnm. Moore ABSENT: Comns . Cutler, Ebey Required Findings: 1. . . . because the existing house was built in 1949 with a reduced sideyard; if the addition were n:oved in to conform with the legal setback, there would be alnost no light available to the kitchen and limited access to the back.yard. 2 . . . . because a nurrilJer of properties m the i.mrediate area have si.mi..lar reduced setbacks on the original house and the addition; similar variances have been granted on Valley Park Street. 3. . . . because the setback is already established by the position of the house; there is sufficient access for fire protection; no one appeared to speak in opposition at the public hearing; six resident neighbors signed a petition in favor of the variance, including the IIDst-affectedneighbor. 4. . .. because use and occupancy of the property will not be changed; therefore, the general plan is not affected. Motion by Cornn. DeBellis, seconded by Conm. Williams, to declare that RB 82-015 is Ii.nadequate as written and that the Board of Zoning AdjustrrEnts will send back the report for rewriting and have it returned to the Board of Zoning Adjustnents for reconsideration. No objections. So ordered. HB 82-017 -Senior Citizen Single Family Residence (as seccmd unit) in R-1 zones Motion by Cornn. Toth, seconded by Coom. Merrill, that the Board of Zoning Adjustrrent ccmsider HB 82-017 as being acceptable, adequate, not significant and that a negative declaration be filed. (see below). Cornn. Williams asked about parking requireIIEnts. Mrs. Duke replied that the state law does not address parking. However, she infonned the Board that they could add to their m::,tion that the report is adequate and not significant providing that the City Code parking requireirents are net for the existing residence. Conm. Toth stated that, in case sorre of the units do not have two parking spaces, they should be required to have current R-1 parking. as a mitigation measure. He aJreTided his nntion to include that requirenent. Corrm. Merrill, seconder of the rrotion, accepted the arrendmmt. Conm. DeBellis stated that he would vote against the notion because it would be irrpossible to enforce HB-82-017. He noted that the report cited places much different from Herunsa Beach in their examples. Moore None Comns. Cutler, Ebey BOARD OF ZONING ADJUSTI1ENTS -June 7, 1982 MISCELLANEOUS (Cont.) Bootlegs -Workshop with BZA Mrs. Duke stated that the Plarming Corrmission requested to kn.O'W' if June 14 or June 17 would be rrore preferable to hold a workshop session on Bootleg Units. Conms . Toth and Williams and Chnn. Moore preferred Jlm.e 14, 1982. Coom. DeBellis stated that he would be unable to attend either night. Mrs. Duke stated that she will reply to the Planning Depart:Irent that neither June 14 nor Jme 17 will the entire Board be able to attend; hawever, Monday, June 14, was m::>re preferable than June 17.
