Cutler Pledge of Allegiance led by Corrm. Cutler ROLL CALL PRESENT: Conms . Cutler, Toth, Williams ABSENT: CcmTIS . Ebey, Chim. Moore ALSO PRESENT: Laurie Duke, Staff Liaison Cornn. Cutler was appointed Chai.man for this meeting. Conm. Toth was appointed Secretary for this meeting . . Conm. Ebey and Crum. Moore had excused absences for this ~eting. APPROVAL OF MINUTES Motion by Chrm. Cutler, seconded by Comn. Toth, to approve the October 18, 1982 minutes, as submitted. No objections. So ordered. APPROVAL OF RESOLUfIONS Motion by Chnn. Cutler, seconded by Corrm. Toth, to approve Resolutions BZA 154-487, 154-489, and 154-471. No objections. So ordered. CONSENT CALENDAR PEIR HB 82-034 -City wide -Remval of the three-story height limitation on buildings iri connercial ~zones. Chim. Cutler stated that this item had been withdrawn by the Planning Depart:Jrent for rewriting. SIGN REVIEW HEARING -422 Pier Avenue Applicant: Gerardo Sabatino Mrs. Duke gave staff report. She stated that the proposed sign presently exists at 37 14th Street. She stated that the applicant had the sign built for his Italian restaurant. The applicant requested to nnve the sign to 422 Pier Avenue as he is relocating his restaurant. She noted that it would not require a sign variance were it not for the fact that the street frontage of the new restaurant is smaller than the street frontage of the building at 37 14th Street. She described the sign as being an illuminated double-face sign. She stated that the new location is in the C-2 zone and has 16 1/2 feet of building frontage, which allows the BOARD OF ZONING ADJUSI'MENTS MINUIES -November 1, 1982 Page 2 SIGN REVIEW HEARING (Cont.) applicant 1½ sq. ft._ for each linear foot of building frontage:, therefore, the applicant is allowed 24-3/4 sq. ft. The project is 213 sq. ft. She added that the City Council has established a policy to count only one side of a double-face sign, The applicant would be within allowable sign area if only one side of the sign were counted. In staff's recoomendations to the City Council for changes to the sign ordinance, it is being recorrmended that on a double face sign, only one-half of the area of the second side be counted into sign area. She stated that the sign may project three (3) feet because it will be 12 feet high. This is based on a formula that a projecting sign must be 8 ft. high to project one foot, and for every 1/2 ft. projection beyond that anvunt, the sign nrust be one foot higher. Corrrn. Toth stated that the request was minor in nature, Public hearing opened at 7:45 p.m. Mrs. Funicello, 422 Pier Avenue, Henmsa Beach, applicant, stated that she is partners with the Sabatinos. Public hearing closed at 7:46 p.m. Motion by Conm. Toth, seconded by Corrm. Williams, to approve a 31 x 61 double face sign to be located at 422 Pier Avenue. Chmn. cutler stated for the applicants• benefit that the fact that the sign is rrerely being relocated did not have a bearing on the Board's decision. He stated that the Board discussed the merits of the sign as if it were not exist-ing at this tim8. Comn. Toth stated that the sign is within the guidelines of the suggested changes to the sign ordinance, and it is in keeping with the wishes of the City Council. AYES: NOES: ABSENT: Carrns. Toth, Williams, Chmn. Cutler None Cornns. Ebey, Moore Chmn. cutler stated that this item may be appealed in writing to the City Council within ten days. Mrs. Duke instructed the applicant to contact the Building Department. Motion by Ch!nn. Cutler, seconded by Coom. Toth, to adopt the findings suggested by staff. No objections, so ordered. REVIEW None MISCELLANEOUS Corrm. Williams stated that there had been no action on the bootleg unit located next to her residence. .. BOARD OF ZONING .ADJUSTMENTS MINUTES -November 1, 1982 Page 3 MISCELLANEDUS (Cont.) Mrs. Duke stated that the case in question had been tried in court , and the City won the case. The applicants are required to rerrove cooking facilities and are on surrmary probation for two years. Chmn. Cutler stated that he had been approached by persons questioning the article in the L.A. Ti.Ires concerning conflict of interest by persons on the City C.ouncil. He asked if the City Attorney could appear at a BZA iooeting to suhnit input regarding this item. He wished to know the rights of the rrerrbers of the Board to approach the City Gouncil to clarify a position of the Poard on an appeal item and the rights of the City Council to appear before the Poard. Mrs. Duke stated the request would require the approval of the City Manager and perhaps the City Qmncil to incur extra hours on the part of the City Attorney. Cbmn. Toth stated that written correspondence fran the City Attorney regard-ing this item v.ould suffice. Cbmn. Will.iams believed that the Board menu:>ers should be allowed to appear before the City Council. Cbmn. Cutler requested that an article dated Thursday, October 28, 1982 in the Los .Angeles Times entitled, "Councilman at Edge of Conflict of Interest" be xeroxed and made part of the comnissioners' notebooks.
