Meeting called to order at 7: 30 P .M .. by Chnn. Moore Pledge of Allegiance led by Chrm. Moore ROIL CAIL PRESENT: Conms. Cutler, Ebey, Toth, Williams, Chmn. Moore ABSENT: None ALSO PRESENT: Laurie Duke, Staff Liaison; Dana Stoike, Planning Intern APPROVAL OF MINUI'ES Motion by Conm. Toth, seconded by Cornn. Williams, to approve the Novenher 15, 1982 minutes, as submitted. No objections. So ordered. APPROVAL OF RESOLUTIONS Motion by Cornn. Cutler, seconded by Coom. Toth, to approve Resolution B. Z .A. 154-45 3. No objections. So ordered. CONSENT CALENDAR None PUBLIC HEARINGS None REVIEWS PEIR HB 82-034 -City Wide -Rerroval of the 3-story height limitation on buildings in comrercial zones. (Cont. from 11/15) Ms. Stoike stated that the revised report addressed how the Vehicle Parking District may apply to the elimination of the three-story height limit. Also included in the revised report is the nurroer of acres that are zoned corrrrercial use. She stated that if eve-ry lot in the City were built to four stories, there may be a growth-inducing irq)act; however, the chances of that happening are very slim. Therefore, she felt that the growth-inducing inJ,acts would not be. 'Significant. Conm. Toth stated that parking was not a basic consideration. His concerns were for t.li.e height limit. Williaim, to approve PEIR HB 82-034 and declare that it is adequate, nonsignificant, and that a negative declaration be filed. The Board does not find significant negative environrrental impacts. Conm. Cutler asked why three PEIR' s were on the sane agenda. Mrs. Duke replied that the three items were put on the saJIE agenda because they were brought forth at the sane tirrE and to facilitate matters. Corrm. Williams noted that it was not the Board's decision to determine mether they agreed with the report; the Board's function was to determine whether it was an adequate report. Chim. Moore stated that he fmnd the report to be acceptable at the last rreeting. He stated that his concern was that the projects would start coming in at 46, 47, and 48 feet·, as opposed to 45. feet. Cornn. Cutler stated that the report included no evidence that the City had lost major contracts of developrrEntal opportunities. Comn. Toth stated that Hennosa Beach is mdercomIErcialized in terms of revenues. Ms. Stoike infomed the Board that the Planning Corrmission will decide whether the proposal is appropriate for the City, and it will then be forwarded to the City Council. Cornn. Cutler stated that if evidence were presented that grOvlth would be inhibited, that, in itself, would be a potential negative inpact. He believed the report to be inadequate. Conm. Cutler asked if the notion could be divided into two separate notions. Cbmn. Moore replied in the negative, stating that one nrust agree with both parts of the rootian to support the notion. Williams felt that there were significant negative environIIEiltal inpacts. Comn. Cutler_ felt the report to be inadequate. Conm. Ebey stated that the third paragraph on page 2 is rrerely a Sllpposition. Chrm. Moore stated that without an adequate report, the Board cannot corre to a decision. CoilillS. Cutler, Ebey, and Williams felt that there would be a significant negative impact; Comn. Toth and Chmn. Moore felt there would not be a significant negative irrpact. Cutler, that PEIR HB 82-034 is adequate, . significant , and that a negative declaratim be filed. (Withdrawn. ) Chmn. Moore stated that the above notion was internally inconsistent. Motion by Cornn. Cutler, seconded by Corrm. Williarrs, that PEIR HB 82-034 is adequate; however, it suggests significant negative environmental inpacts. AYES: NOES: ABSENT: Conms. Cutler, Williams CoilillS . Toth, that PEIR HB 82-034 may have significant effects on the environrrent, and an envirormental i1ll)act report is required. (With.drawn. ) Chrnn. Moore stated that none of the three possible rotions rrentioned the adequacy or inadequacy of the report. Mrs . Duke stated that the making of one of the three motions is assuming that the report is adequate . Motion by Chrm. Moore, seconded by Cann. Cutler, that PEIR HB 82-034 is adequate. Moore ABSENT: None PEIR HB 82-035 -City v..1:ide .,; Bed and Breakfast £or Rerit Rooms Corrm. Cutler asked my there is a need for nore accrnrodations in Hernosa Beach. Cornn. Williams replied that it is because of the Olylll)ics. Chnn. Moore felt the report to be adequate ; however, he noted ccmcern for the possibility of units turning into bootleg units. Toth felt that the report covered all the possible alternatives and negative ~acts of the report. Comn. Cutler stated that the cost of enforcing this could drain the resources of the City. • Chnn. Moore felt that the report did not adequately point out the danger that it may be misused by property owners to rent long tenn bootleg uni ts under the guise of bed and break.fast places. Conm. Toth felt that the report clearly defined what was tenporary and what was lang-tertn. He added that the report also indicated the negative, adverse environmental inpacts; therefore, the City Council would be aware of those adverse inpacts . He noted that he was not in favor of bed and break.fast rent rooms in Henrosa 13each. Motion by Cornn. Toth, seconded by Corrm. Ebey, to declare th.at PEIR. HB 82-035 is adequate and significant and that a negative declaration be filed. (Withdrawn.) Chnn. • Moore stated that although there are possible significant effects on the environDElt, there will not be a significant effect in this case because of the mitigation neasures described in the report. Ms. Stoik.e noted that these will require conditional use permits which have vecy stringent requir~ts. Motion by Chnn. Moore, seconded by Conm. Wi.lliams, to declare PEIR HB 82-035 as being adequate and that possible significant negative inpacts have been identified; however the mitigation treasures outlined in the report address those inJ>acts. Therefore , the Board felt there were not significant effects m this case and requested that a negative declaration be filed. AYFS: NOES: ABSENT: Conms . Toth, Williams , Chrm . Moore Conm.. Cutler, Ebey None PEIR HB 82-036 -C-2, C-3, and R-3 Zones -An:ending the Zoning Code to include specific defiriitioris of the following ·uses: hotels, rrotels, boarding bouses ·and rcfoming/lddging houses:· ·and designating m 'wliidi ·zones ·said ·uses will be ·permitted. C.Onm. Cutler noted an error in the report, that is, that rrotels are differentiated in terns of parking and also in terms of access . Conm. Williams asked for a clarification of the definitions of hotels and irotels. Ms. Stoike replied that hotels have parking underneath, or they are pedestrian oriented. Hotels also usually have a lobby entrance, and there is access from within the building. Motels usually have mclividual accesses. ' .. Mrs. Duke replied that the cornrercial area on the Strand is zoned C-2. Mrs. Duke stated that nntels and hotels have the same parking require~ts, that is, one space for each living unit and two spaces for the man.ager' s unit. Chun. Moore asked if there were any different requirerrents for a hotel and a IIDtel. Ms. Stoike stated that rrotels can include kitchen facilities, whereas hotels cannot include kitchen facilities. Corrm. Cutler asked hav easy it would be for sOOEone to establish a rooming house or boarding house from an existing &velling. Mrs. Duke replied that there have been no applications. It would also require a conditional use penni t. Coran. Cutler asked if there were any rooming houses or boarding house in Hernosa Beach. Conm. Ebey replied in the affirmative. Conm. Cutler stated that page 4 indicated that boarding houses and rooming houses do not require a condi tonal use permit. Chlm. Moore stated that the report e}4llained that the project proposes to change Boarding Houses and Rooming/Lodging Houses from a con.di tional use in comrercial zones to a pennitted use in R-3 zones. Chim. Moore asked who was eapcwered to decide whether or not a conditicnal use pe:rmit is required. Mrs. Duke replied that the Plarming Comni..ssion is empcwered to make that decision. Motion by Conm. Cutler, seconded by Conm. Toth, that PEIR HB 82-036 is adequate, and there are likely no significant adverse envirorurental impacts only if Alternative 1/3 is adopted by the Planning Comni.ssion and that a negative declaration be filed.
