A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA
BEACH, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT TO ALLOW
ON-SALE BEER AND WINE IN CONJUNCTION WITH A RESTAURANT AND
ADOPTION OF A ENVIRONMENTAL NEGATIVE DECLARATION FOR 1605 PACIFIC
COAST HIGHWAY, PICASSO'S ITALIAN CAFE, LEASE SPACE LOCATED IN THE
NORTHEASTERN MOST PORTION OF THE PAVILION, AND LEGALLY DESCRIBED
AS A PORTION OF LOT 13 AND SOUTHERLY 6.24 FEET OF A PORTION OF
LOT 14, BLOCK 81, SECOND ADDITION TO HERMOSA BEACH
WHEREAS, the Planning Commission held a public hearing on
January 15, 1991, to receive oral and written testimony regarding
a Conditional Use Permit request to authorize the sale of general
alcohol in conjunction with a restaurant and made the following
findings:
A. The sale of beer and wine would be conducted in an
establishment located inside an existing mal 1, the Hermosa
Beach Pavilion;
B. The proposed use is compatible with surrounding commercial
uses and with surrounding residential uses;
C. Strict compliance with the conditions of approval will
mitigate any negative impact resulting from the issuance of
the conditional use permit and will protect the public
health, safety, and welfare;
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission
of the City of Hermosa Beach, California, does hereby approve a
Conditional Use Permit, to authorize the sale of beer and wine in
conjunction with a restaurant at 1605 Pacific Coast Highway,
subject to the following conditions:
1. The establishment shall not adversely affect the welfare of
residents, and/or commercial establishments nearby.
2. The hours of operation shall be limited to between 10:00 A.M.
and 1:00 A.M.

3. The use of the outside dining area shall only be authorized
by approval of a master conditional use permit for outside
dining within the Hermosa Pavilion and shall be subject to
the conditions of said master outside dining C.U.P ..

12. The exterior of the premises shall be maintained in a neat
and clean manner at all time.
13. Alcoholic beverages shall be sold only to individuals over 21
years of age.
14. The business owner shall participate in the EASY program (End
Alcohol Sales to Youth). Participation to be verified and
monitored by the Police Department.

15. Any changes to the exterior or interior design shall be
subject to review and approval by the Planning Director.
16. A maximum of 35% of the gross receipts of the restaurant
shal 1 be from the sale of alcoholic beverages. The City
shall have the right during business hours, upon 15 days
notice, to inspect the books and records of the establishment
to determine the gross sales of alcoholic beverages. Upon
request at the inspection, the establishment shall submit to
the City, copies of all records submitted to the State Board
of Equalization for the purpose of verifying the
establishment's books and records, with the understanding
that these reviews are confidential.
17. Prior to the conditional use permit being in effect, the
applicant shall submit to the planning department, a signed
and notarized "Acceptance of Conditions" form.
18. A conditional use permit shall be recorded with the deed, and
proof of recordation shall be submitted with the planning
department.
19. The Planning Commission may review the conditional use permit
and may amend the subject conditions or impose any new
conditions if deemed necessary to mitigate detrimental
effects on the neighborhood resulting from the subject use.
20. Each of the above conditions is separately enforced, and if
any of the conditions of approval is found to be invalid by a
court of law, all the other conditions shall remain valid and
enforceable.
