A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA
BEACH, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT AUTHORIZING
AN AUTO BODY REPAIR AND PAINTING ESTABLISHMENT FOR 1231 PROSPECT
AVENUE, LEGALLY DESCRIBED AS LOT 40, HERMOSA HEIGHTS TRACT
WHEREAS, the Planning Commission held a public hearing on
September 3, 1991, to receive oral and written testimony
regarding an application for a Conditional Use Permit at 1231
Prospect Avenue and made the following findings:
A. The applicant is requesting a conditional use permit to
authorize the existing use of auto body repair and auto
painting as required by Section 13-5.
C. The development, as conditioned, mitigates the potential
threat to public health, safety and welfare;
D. The proposed use is compatible with the surrounding
commercial activities in close proximity along Aviation
Boulevard, and the imposition of conditions as required by
this resolution will mitigate any environmental impacts;
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission
of the City of Hermosa Beach, California does hereby approve a
Conditional Use Permit to allow the uses of auto body repair and
painting subject to the following:
SECTION I Conditions of Approval
1. The public right-of-way shall not be used f o r the parking or
storing of vehicles that are intended for sal e or service.
2 . Test driving of vehicles on local residential streets shall
be prohibited.
3 . All auto repair, painting and detailing shall be conducted
inside the building, and all outdoor work activities shall be

prohibited (minor examination of vehicles for the purpose of
estimates not lasting more that 15 minutes, and the initial
washing of cars is allowable).
4. Noise emanating from the property shall be within the
limitations prescribed by the City's noise ordinance, Article
19.5 of the Hermosa Beach Municipal Code, and shall not
create a nuisance to the surrounding residences and
commercial establishments.
5. All outdoor parking and driveway areas shall be maintained
free of unregistered and derelict vehicles, wrecked vehicles,
and/or parts and debris.

County, and proof of recordation shall be submitted to the
Planning Department.
12. The location of structures and features on the property shall
be in substantial conformance with submitted plans; any
modification shall be submitted to the Planning Director for
approval.
13. Any application of flammable paints and finishes shall be
conducted within an approved paint booth, subject to permit
approval by the Fire Department, and shall be in conformance
of Article 45 of the Fire Code, and spray painting of
vehicles shall be subject to permit approval by the South
Coast Air Quality Management District.
14. Odor elimination equipment shall be provided for the
building, including for the paint booth, and it shall be
reviewed and approved by the Planning Director.

20. The 5' X 7' trash enclosure shall be maintained in the
location shown on the plans, enclosed on three sides with a
decorative masonry wall of five (5) feet in height and
maintained on a concrete base. A view obscuring gate shall
be provided for the fourth side.
21. A landscaped planting area shall be provided in the portion
of the front yard setback adjacent to the inoperable section
of the front gate.
(a) A landscape plan indicating size, type, and quantity of
plant materials shall be submitted and shall be reviewed
and approved by the Planning Director.
(b) An automatic irrigation system shall be provided for all
landscaped areas.
(c) Said landscaping improvement shall be implemented within
six (6) months of the date of the adoption of this
resolution.
22. The exising block wall along the property lines shall be
maintained in a neat and clean manner. Said walls may not be
removed without the approval of the Planning Director.
23. The hours of repair activity shall be limited to between 8:00
AM to 6:00 PM Monday tbru Friday and from 9:00 AM until 1:00
PM on Saturdays. Customer pick-up and drop-off of vehicles
may occur beyond these hours.

SECTION II
Each of the above conditions is separately enforced, and if any
of the conditions of approval is found to be invalid by a court
of law, all of the other conditions shall remain valid and
enforceable.
SECTION III
Any violation of the conditions of approval and/or violation of
the Hermosa Beach Municipal Code may be grounds for a public
hearing for the revocation of the conditional use permit.
The Planning Commission may review this Conditional Use Permit
and may amend the subject conditions or impose any new conditions
if deemed necessary to mitiga te detrimental effects on the
neighborhood resulting from the subject use.
