A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA
BEACH, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT TO ALLOW
AUTO SALES ON THE PROPERTY AT 125 PACIFIC COAST HIGHWAY, LEGALLY
DESCRIBED AS A PORTION OF LOTS 1 THROUGH 6, INCLUSIVE, LOTS 7 AND
8, TRACT 5019, AND LOT 142, WALTER RANSOM COMPANY'S VENABLE
PLACE.
WHEREAS, the Planning Commission held a public hearing on
August 20, 1991, to receive oral and written testimony regarding
an application for a Conditional Use Permit at 125 Pacific Coast
Highway for an auto sales business and made the following
findings:
A. The applicant is proposing to open a new business on an
interim bas is to sel 1 used autos from a portion of a site
previously used for an auto dealership;
B. The site is zoned SPA-7 and the building and the site are
adequate in size, and provide sufficient parking, to support
the proposed business activity on an interim basis, however,
if the use is extended beyond a year further improvements
will be necessary;
C. The development, as conditioned, poses no threat to the
public safety and welfare;
D. The proposed use is compatible with surrounding commercial
activities along Pacific Coast Highway and the imposition of
conditions as required by this resolution will mitigate any
environmental or negative impacts on nearby commercial and
residential properties;
E. The proposed use is consistent with the Commercial Corridor
General Plan designation;
NOW, THEREFORE, the Planning Commission of the City of
Hermosa Beach, California does hereby approve a Conditional Use
Permit to allow auto sales at 125 Pacific Coast Highway subject
to the following conditions:

SECTION I
1. The development shall be as indicated on submitted plans and
the business activity shall be limited to the areas
identified; any modification shall be submitted to the
Planning Director for approval, any expansion shall require
an amendment to the conditional use permit.
2. Outside work activity on vehicles shall be strictly
prohibited.
3. The use of the property shall be limited to auto sales, auto
repair shall be prohibited without and amendment to the
conditional use permit.
4. Test driving of vehicles on local residential streets shall
be prohibited.
5. All outdoor vehicle storage, parking and driveway areas shall
be maintained free of unregistered and derelict vehicles,
wrecked vehicles, or parts and debris.
6. Storage of trucks, tractors, trailers, Recreational Vehicles
and/or boats in the parking areas or any other location on
the premises shall be prohibited, except those vehicles for
sale.
7. Adequate on-site parking spaces shall be provided for
employees. Use of residential street~ and Pacific Coast
Highway for parking employee automobiles shall be prohibited.
8. Parking spaces identified for customer parking shall not be
used for displaying automobiles for sale or for any auto
merchandise.
9. The hours of operation for the auto sales business shall be
limited to 7:00 a.m. to 10:00 p.m. daily.
10. Examining, installing, or repairing car alarm systems shall
be prohibited.
11. There shall be no outdoor bells or buzzers or
apparatus. Outside speakers for paging or any other

12. The exterior of the premises including the parking areas
shall be maintained in a neat and clean manner at all times.
13. All exterior lights shall be located and oriented in a manner
to insure that neighboring residential property and public
right-of-way shall not be adversely affected.
14. The chain-link fence located around the perimeter of the
parking area north of the showroom shall be removed.
15. Further improvements to the property shall be required if the
operation of the used car sales business extends beyond one
year from the date of approval as follows:

A landscape strip, m1n1mum of 5 feet wide, shall be
provided along the Pacific Coast Highway frontage. A
plan for landscaping shall be submitted for review and
approval by the Planning Director and shall include an
automatic irrigation system.
The remainder of the chain-link fence around the
perimeter of the parking area south of the showroom
shall be removed.
Prior to the conditional use permit being in effect, the
applicant shall submit to tbe planning department, an
"Acceptance of Conditions" form, signed by the PROPERTY
OWNER, and notarized.
The conditional use permit shall be recorded, and proof of
recordation shall be submitted with the planning
department.
SECTION II
Each of the above conditions is separately enforced,
of the conditions of approval is found to be invalid
of law, all the other conditions shall remain
enforceable.

Any violation of the conditions of approval and/or violation of
the Hermosa Beach Municipal Code may be grounds for citation
and/or a public hearing for the revocation of the conditional use
permit.
The Planning Commission may review this Conditional Use Permit
and may amend the subject conditions or impose any new conditions
if deemed necessary to mitigate detrimental effects on the
neighborhood resulting from the subject use.
