HomeMy WebLinkAboutPC Resolution 91-20 - (131 Pier)(--1 2 3 4 5 6 7 8 9 10 11 12 13 / 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION P.C. 91-20 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA BEACH, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT AND PARKING PLAN TO ALLOW A MARTIAL ARTS STUDIO WITH ONE-ON-ONE TRAINING, AND ADOPTION OF AN ENVIRONMENTAL NEGATIVE DECLARATION, AT 131 PIER AVENUE AND LEGALLY DESCRIBED AS LOT 22, BLOCK 34, FIRST ADDITION TO HERMOSA BEACH TRACT. WHEREAS, the Planning Commission held a public bearing on March 19, 1991, to receive oral and written testimony regarding a request for a conditional use permit and parking plan to allow a martial arts studio with one-on-one training and made the following findings: A. The proposed martial arts training facility will be for one-on-one training only, no group classes or group training will be provided, and no expansion of the building is proposed; B. The existing building is nonconforming to parking requirements as no off-street parking is available on the site, however, on-street public parking is available in-front of the business, and the demand for parking, because of the unique one-on-one aspect of this facility, will not be any more intense than that of the previous retail use or any other permissable retail or office use of the space; C. The proposed use is appropriate for the subject area and will be compatible with surrounding uses; D. Strict compliance with the conditions of approval will mitigate any negative impacts resulting for the issuance of the conditional use permit and parking plan; NOW, THEREFORE, the Planning Commission of the City of Hermosa Beach, California does hereby approve a conditional use -I - .. 1 r 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 permit and parking plan to allow a mart i al arts studio with one-on-one training, and adoption of an environmental negative declaration subject to the following conditions: 1. The proposed project shall be in substantial conformance with submitted plans. Any modifications shall be reviewed and approved by the Planning Director. 2. On site training shall be limited to a maximum of one-on-one training (one teacher and one student) at all times. 3. The establishment shall not adversely affect the welfare of residents, and/or commercial establishments nearby. 4. The exterior of the business shall be maintained 'in a neat and clean manner at all times. S. All signs shall comply with the City Sign Ordinance. 6. Prior to the Conditional Use Permit being in effect, the applicant shall submit to the Planning Department, a signed and notarized "Acceptance of Conditions" form. 7. The Conditional Use Permit shall be recorded with the deed, and proof of recordation shall be submitted to the Planning Department. 8. The Planning Commission may review this Conditional Use Permit and may amend the subject conditions or impose any new conditions if deemed necessary to mitigate detrimental effects on the neighborhood resulting from the subject use.
