P.C. RESOLUTION 91-28
A RESOLUTION OF INTENTION OF THE PLANNING COMMISSION OF THE CITY
OF HERMOSA BEACH, CALIFORNIA, TO STUDY POSSIBLE TEXT AMENDMENTS
PERTAINING TO THE DEFINITION AND REGULATION OF ADULT USES
WHEREAS, the Planning Commission held a public meeting on
April 16, 1991, and made the following Findings:
A. The zoning ordinance currently permits adult uses ("adult
book stores," "adult newsrack," and "adult theatres,") in the
General Commercial, C-3, zone, with a conditional use permit.
Section 10-5 states that such a permit shall be issued for
book stores and theatres when the establishments are located
at least 100 feet from a residentially zoned property, and at
least 1000 feet from property zoned or used for a church,
school, or park purposes, or another adult establishment.
Section 10-6 also states that such a permit shall be issued
for adult newsracks when it is located at least 1000 feet
from a church, school, or part and at least 500 feet from any
other newsrack or adult book store. These regulations need
to be studied for their reasonableness, and whether or not
adult uses may be undesirable enough to be eliminated from
the permitted use list;
B. The current definitions of adult uses are not clear as to
what constitutes an adult use when adult books, video, or
magazines are being sold in conjunction with or ancillary to
another permitted use;
C. The definitions need to be studied for possible amendments to
clarify when a business only partially sells or rents adult
items;

D. These issues need to be studied in terms of applicable State
and Federal laws;
NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission
of the City of Hermosa Beach, California, does hereby direct
staff to study possible amendments to the zoning ordinance
pertaining to the definition and regulation of adult uses.
