HomeMy WebLinkAboutPC Resolution 91-29 - (320 PCH)1 r 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION P.C. 91-29 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA BEACH, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT AND PARKING PLAN FOR SHARED PARKING TO ALLOW THE OPERATION OF A MARTIAL ARTS STUDIO (AL JOHNSON'S KARATE STUDIO) IN A RETAIL BUILDING IN CONJUNCTION WITH RETAIL USES, AND ADOPTION OF A MITIGATED ENVIRONMENTAL NEGATIVE DECLARATION, AT 320 PACIFIC COAST HIGHWAY, LEGALLY DESCRIBED AS LOTS 1, 3, 5, 7, AND 9 MISSION TRACT AND LOT 13 HURD'S OCEAN VIEW TRACT WHEREAS, the Planning Commission held a public hearing on May 7, 1991, to receive oral and written testimony regarding an application for a Conditional Use Permit and Parking Plan and made the following findings: A. The proposed Martial Arts Studio is a low intensity training facility, offering group classes of limited size to both children and adults, with the largest adult classes being held at night only, beginning at 7:00 P.M. or later; B. The parking lot which will contain 25 spaces can support the proposed activity in conjunction with the two retail business which share the same parking lot, as demands during the day will be light, and because its peak use will be at times when demands for retail are light; C. The proposed use is compatible with surrounding residential and commercial uses; D. With compliance with the mitigation measure to limit class sizes, the proposed occupancy of the existing building will not result in any direct or indirect significant impacts on the environment; E. Strict compliance of the conditions of approval will mitigate any negative impacts resulting from the issuance of the Conditional Use Permit and Parking Plan. - 1 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Hermosa Beach, California does hereby approve a Conditional Use Permit, Parking Plan, and Environmental Negative Declaration subject to the following: SECTION I Conditions of Approval: 1. The proposed development shall be in substantial conformance with submitted plans and the indicated class schedules. Any modifications to the plan. or significant modification of the class scheduling shall be reviewed and approved by the Planning Director. a. The proposed re-striping of the parking lot (resulting in 25 parking spaces) shall be completed within thirty (30) days of the date of approval of this conditional use permit/parking plan. 2. Individual parking spaces shall not be marked or reserved for use by any particular tenant. Al 1 parking spaces shal 1 be available at all times to any employee or customer of all the businesses within the building. 3. Group classes, shall be limited in size as follows: a. Classes commencing before 7:00 P.M. shall be limited to a maximum of eight (8) adults (18 years of age or older). b. Classes commencing at 7:00 P.M. or later shall be limited to a maximum of eighteen (18) adults (18 years of age or older). c. No class, including adults and children, shall exceed a total of twenty (20) students. 4. The parking lot and its perimeter shall be improved to conform to current standards for landscaping and buffering from adjacent residentially zoned property, and to improve the appearance from Third Street, as follows: a. A minimum five (5) foot wide landscaping strip shall be provided along the easterly property 1 ine and shal 1 be landscaped with at least one 24-incb box specimen size tree for each ten feet of length (12 trees). b. i. Three (3) copies of a landscaping plan indicating size, type and quantity of plant materials, and an irrigation plan, shall be submitted to the Planning Director for review and approval prior to installation of any landscaping, and shall be reviewed and approved by the Planning Director ii. An automatic irrigation system shall be provided, and shall be shown on plans. A minimum 6-foot high decorative block wall shall be provided along the easterly property line. If the existing wall is used, a decorative textured coat shall be applied to the surface, subject to the approval of the Planning Director. The chain link fence facing Third Street shall be replaced with a decorative block wall, minimum of three (3) feet high. All the above improvements to the parking lot shall be completed on the site within six (6) months of approval of this conditional use permit/parking plan. 5. Hours of operation shall be limited to between 9:00 A.M. and and 9:30 P.M. daily 6. Classes shall commence a m1n1mum of fifteen (15) minutes from the end of any previous class. 7. The establishment shall not adversely effect the welfare of residents, and/or commercial establishments nearby. 8. An employee who is aware of the conditions of this Conditional Use Permit and Parking Plan shall be on the premises of the Martial Arts studio at all times. 9. The rema1n1ng portions of the buildings on the property (other than the martial arts studio) shall be used for retail purposes, or other use which has an equivalent or lesser parking requirement. No new businesses shall be allowed to operate within these areas, nor shall business licenses be issued for any new type of business, or change in operating hours, without the prior review and approval of the Planning Director and/or Planning Commission. 10. The exterior of the premises shall be maintained in a neat and clean manner 11. Prior to the Conditional Use Permit/Parking Plan being in effect the applicant shall submit to the planning department, a signed and notarized "Acceptance of Conditions" form. 12. The Conditional Use Permit/Parking Plan shall be recorded with the deed, and proof of recordation shall be submitted to the Planning Department. SECTION II Each of the above conditions is separately enforced, and if any of the above conditions of approval is found to be invalid by a court of law, all the other conditions shall remain in full force and effect. -3 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION III The Planning Commission may review the conditional use permit and may amend the subject conditions or impose any new conditions based on substantial findings that there are significant detrimental impacts to the adjacent neighborhood as a result of the operation of the business. Any violation of the conditions of approval and/or violation of the City of Hermosa Beach Municipal Code may be grounds for the issuance of a citation of public hearing for revocation of the Conditional Use Permit.
