PROVENCIO, JOE dba 11 JOE CISCO -CONDITIONAL USE PERMIT Public hearing of appl i cation fo r condition~] use p ermit by Joe and Jimmy Provencio, dba "Joe C isco", to serve beer and wine in a bona fide restauran t situated at 1314- 1316 Hermosa Avenue, and legally described a s lots 8 and 9, block 34, Firs t a¢di t ion to Hermosa Bea c h t ract. Mr. Provencio, the applicant, s ta ted t hat he f elt the serving of beer and wine was necessary for his bu siness , a restaurant sp ecia li zing in Mex ic an food, to continue. He wi sh ed to wall o ff an area behind t he dining room of the northern buil ding as a servic e bar, where customers could wai t to be served dinner. The ap p licant was asked a nu mber of q ue s t ions regarding the construction of thi s s ervice bar, and wha t would preclude it f rom becoming a beer bar, if separately encl os ed as he had outlined. Mr. Provencio said that this was not his inten t, end that he wished to lay out the bar in this fa s h ion because 1 1fam ily11 typ e custome rs somet ime s objec t ed to a bar directly off th e dinin g area. Mr. Provencio was al so asked abou t entry to the dining facilities. He explained t hat he wished the main entrance to be thr o ugh 1316 Hermosa Avenue , the northern build i ng, and intended to clos e of f the southern en try. He said that his hours of opera t ion were pr esently from noon to about 10 p.m., but if granted the condi t ional use permit, he proposed to stay open later . . The Chairman asked i f anyon e in the aud i ence wi s hed to speak f or or against the application. No one did so. Th ere was ad dit iona l d iscussio n by th e Commission, and a moti on was made by Comm . Armer, s econded by Comm. Boi c e, to g rant t he conditional use permit. Motion carried by the following vo t e: AYES: NOES: ABSENT: Comm.Ha milton , Boic e, Chairman Viault Comm. Armer, Stabler Comm. Noble, Reeves Moti on was made by Comm.Hamilton, seconded by Comm. Boi c e, to adopt P.C. 154-635, grantin g the con ditional use permi t with t he p r ov isions t hat the p rop ~s ed wall to be erec t ed as a bar divider between the d i n i ng r oom and t he bar, should not exceed 50% of the area across the northerly and s o utherly direction of the r oom , and that 50% of the entire area of this wall is to be an op en screen wall. Further prov i sion to be that the bar be r es t ri ct ed to 400/o of the f loor area of the northern bui I ding, an d to be located in t he eastern por ti on of said building, and that it be limited Planning Commission Page 2 Meeting 1/8/68 CISCO CONTINUED: to no more than ten (10) bar stools; and with the stipulation that it wi 11 be permitted only as long as the operation of this business is primarily that of a bona fide restaurant. Motion carried by the following vote: AYES: NOES: ABSENT: Comm. Hami ]ton, Boice, Chairman Viault Comm. Armer, Stabler Comm. Reeves, Noble Reasons for granting were given on the basis that the serving of beer and wine in conjunction with Mexican food is deemed to be necessary and that it wi 11 not be materially detrimental to the public welfare, nor does it adversely affect the Comprehensive General Plan. Comm. Armer stated his reasons for voting 11 no 1 1 as follows: 1. That as a commission we should be more discriminate in the granting of these conditional use permits. 2. That the serving of beer and wine appears to be not incidental to the serving of food, but to be the primary reason for existence. HAGGERTY, PALMER, MCMILLEN -ZONE VARIANCE Public hearing of application for zone variance by Thelma and Karl B. McMillen, Jr. (owners), and D. K. Haggerty and K. E. Palmer (prospective buyers), to erect a 30 unit, 3 story apartment house; al] one bedroom apartments, with 37 garages in lieu of required 45 garages. Land area per dwelling unit 447 square feet in lieu of required 600 square feet. Land coverage 87% in 1 ieu of required 75%. Allow stair­ ways to encroach into east and west sideyards 20 11 into required five foot setback. Rear setback first floor to be 1 ft. from property line in lieu of required 3 feet. Property situated at 33 15th Street, and legally described as lots 19, 20, 33, 34 35, Block 16, Hermosa Beach tract. The Secretary read correspondence which related to the application, as well as a letter of protest from E. R. Schaad of Laguna Beach. Preliminary plans and a rendering of the proposed structure were displayed. Messrs Haggerty and Palmer were present to speak in behalf of the application. Mr. Haggerty explained that in keeping with the present trend toward one-bedroom apartments, he wished to develop the property in this fashion. He intended to keep rentals at a level which would encourage high calibre tenants, and that the apartments would be rented primarily to single tenants, thereby eliminating the need for extra parking facilities. Mr. Haggerty believed that the proposed apartment was in keeping with the Precise Plan for the downtown business district, and that it would increase business acitivity as well as providing an impetus for other developers to invest in the area. Planning Commission Page 3 Meeting 1/8/68 HAGGERTY -PALMER CONTINUED: Speaking in favor of the application were Mr. David Shumaker, who owns four lots within 300 feet of the proposed development; Mr. John lnscho,owning three lots adjoining the applicant 1 s property; a gentleman from 3133 Strand; Mr. Ed Begrosian(sp) who lives on 16th Street. All expressed the thought that granting of the application would upgrade and benefit the neighborhood, and the business district. Speaking against the application were Mr. and Mrs. Howard Staten of J6-16th Street; Mr. and Mrs. Brubaker of 41 -16th Street; John Berggren, who owns three lots on 15th Street and the Strand. The main concern of those opposing the application, involved the traffic conditions and parking problems which might occur. The public hearing was closed and the Commission discussed fire exits, traffic inside and outside of the proposed building, and data prepared by Mr. Sud Trott, Building and Planning Director, relative to density factors in the area. The possibility of underground parking was mentioned, and Mr. Palmer explained that the cost of such facilities could run as high as $60,000, and the additional cost would make the development not economically feasible. It was felt by the Commission that more study and information was required, and that the City Staff supply data regarding utilities, fire hazards, light, ventilation, traffic problems, etc.,which information could be furnished by the various department heads. The public hearing was re-opened and motion made by Chairman Viault, seconded by Comm. Armer, to continue the hearing to an adjourned meeting to be held on January 22, 1968 at 7:30 p.m. in Council Chambers of City Hall. Motion carried by unanimous vote. MARSHALL SMITH -ZONE VARIANCE Public hearing of application by Mr. and Mrs. Marshall Smith for zone variance to maintain and continue the use of a third unit in a R-2 zone. Said unit was con­ Nerted from a laundry and recreation room into a separate dwelling unit without approval from the Hermosa Beach Building Department. Unit having 702 sq. ft. in lieu of required 900 sq. ft. Additional garage facilities to be provided, The applicant, and his attorney, Stephen Claman, were present to speak. Mr. Claman further elaborated on the written presentation which Mr. Smith had given to each Commissioner concerning the history of the property, and to explain that his client had been unaware of the i ]legal conversion, at the time he purchased the property. He stated that his client was asking for a variance to continue something which had been in existence for 14 or 15 years. Speaking in opposition was Mr. Kenneth Leigh of Park Avenue, who felt that if one person were allowed this use, then others might wish the same privilege. Motion to grant the application, provided a two car garage be erected, was made by Comm. Boice, and seconded by Comm. Armer. Motion carried by unanimous vote. Pr ope rty was purchased a s thre e units in 1963 by th e appli c ants and applicants were unaware of any zonin g or bui I ding violations on the property. Mr. James Mc Kinsey, lessee, presented plans t o t he Commission as requested at their meeting of November 13, 1967, Afte r discu ss ion ab out the ty pe of planti ng and some questions regarding p,~rking requir ements in the f utur e, sho uld the development chang e, a motion was made by Comm. Ha mi lton, seconded by Comm. Boi ce, tha t a let~er be d i rected to t he Building and Plannin g Director appr ovin g parking a nd plan t ing p lans as submi t ted, and with t he sug gestion that Pa u l Peterson, Park Supervisor, appr o ve the type of planting t o be prov ided. Motion c arri ed unanimously.
