Beach, California, in the Counci J Chambers at 7:30 p.m. on Monday, March 13, 1967.

BUSCHE, KENNETH ANO MARY -ZONE VARIANCE -PUBLIC HEARING CONTINUED:
The public hearing for zone variance application of Kenneth and Mary Busche, was
continued and re-opened. Variance applies to property located at 255 and 257
28th Street, lots 17 and 19, block 114, Shakespeare tract, and requests separation
of lot 17, block 114 from lot 19, block 114, Shakespeare tract by removing all
encroachments between property lines, providing required sideyards except leaving
an existing stairway to the second floor encroaching in the required three foot
sideyard on the westerly side of lot 19, block 114, Shakespeare tract.
Present to speak for the applicants was Mr. Carl Minton, attorney. Sketches
and photographs of the property were shown to the Planning Commission, and a
revised floor plan presented, showing that the bar sink had been eliminated, and
the additional door closed off, with a door to the downstairs bath. Mr. Minton
discussed the hardship involved with having termite clearaace because of the smal 1
amount of space beneath the dwelling which creates a hardship, because of the large
expenditure necessary to clear out the sand prior to access. He mentioned the
other properties in the vicinity which have stairways to their property lines;
the fact that this property is in an R-2 zone and the normal development is two
units; that no residents have come forth to protest the proposed variance, but a
number of residents have written a petition in favor of it. He stated that the
applicants would remove the bedroom and restore it to a garage within one year,
if the Commission was agreeable to this thought.
The Chairman asked whether anyone in the audience wished t0 speak for or against
the application, and no one else spoke. Questions were then asked by the Commission
regarding the placement of the outside stairs, and they were advised that this was
the most feasible location, as indicated on the drawing, since plumbing connections
on another wall would have to be relocated.
Mr. Bud Trott, Building and Planning Director, spoke of the size of the garage which
would have a depth of only 17 ft. 3 inches approximately. To allow this non
conformity, the Planning Commission would have to include permission for this in
their resolution, should they grant the variance,
Motion to grant the variance was made by Comm. Reeves, and seconded by Comm. Boice.

full Commission was present. Motion was made by Comm. Hales, s econded by Comm.

MCKINLEY -TIME EXTENSION FOR VAR IANCE -REVIEW
Request fo r time ex tensi on of Zon e Varian ce, P.C. 154-577, grant e d by th e Planning
Commission on April 11, 1966, to permit applic an t t o erect a two unit dwelling on
an R-3 lo t with 2310 square f ee t of land area in lieu of 2400 square feet of land
a rea re q u i red, o n th at p r ope rty situated at 920 Loma Oriv e, lot 13, Tract 1516.
The applicant, Mr. David McKinley, was present. The Secr et ary read the letter
which Mr. and Mrs. Mckinley had f orwarded with regard to t he request for time
e xtension, Aft er discus sion, the Commission agreed that the tight money situation
durin g th e past yea r had posed a problem with cons truction. A motion was made
by Comm. Reeves, s e conded by Comm. Noble to approve a years extension of t he

GULF OIL STATION -REQUEST FOR TIME EXTENSION TO MAINTAIN TRAILER -REVI EW
Time exten s ion re q uested for permission to keep t railer, being used for an off ice,
a t Gul f Oil Station located at 1131 Pacific Coast Hi gh way. Applican t is Mr. Jeff
Burg, and original per missi on to keep this tra iler was granted on Ju ne 13, 1966,
for a peri od of six months.
Mr. Burg was presen t and explained to the Commission t hat th e money sit uation
had prev ent e d him from acquiring a loan to build the diagoostic cent e r which had
be en his original in t ent. He explain e d that t he trailer was now in a lo cation
which could not be seen fro m t he str eet, and tha t i t was essential to keep the
trailer for office purposes, since no other space was availabl e . Af t er ques tion ing
by the Commi ssi on, Mr. Burg sai d tha t they were once aga in at tempting to secur e a
loan.
Motion was mad e by Comm . Reeves, seconded by Comm. Boi ce , that as originally requested,
time ex t ension be granted for a period of one year from this date, with no ext e nsion
after the 12 month period. The motion car ried unanimously.

It was suggested that since Comm. Boice had to leave the meeting early, that
item 5 on the agenda, Continuation of study and review of possible amendment
of Ordinance N.S. 154, relating to businesses operating without attendants,
open late at night, be postponed until later in the evening and item 6 be heard
at th i s t i me .
AUST -RECONSIDERATION OF ZONE VARIANCE
Public hearing -reconsideration requested by the City Council with a recommendation
to grant, after appeal made to Council. Zone Variance to divide lots 94 and 95
of tract 733 into two parcels. Parcel l being the south 45 ft. of lots 94 and 95;
parcel 2 being the north 45 feet of lots 94 and 95; add over 40% to an existing
building located on the south 45 ft. of lots 94 and 95, containing a two car garage,
rumpus room and 3/4 bath, having non-conforming sideyards of 3. l ft. and 3.26 ft.
in lieu of the required 5 ft. Second story addition to have two bedrooms, living
room, kitchen and bathroom. Request to maintain the same sideyards on second
story addition as existing. Variance originally denied by P.C. Resolution No.
154-604 on February 14, 1967.
Mr. Bud Trott, Building & Planning Director, gave a brief summary of the Council
meeting at which Mr. Aust 1 s appeal had been heard. Comm. Hales stated that he
had also been present at this meeting.
Mr. Aust, the applicant, spoke and once again explained the hardship which was
involved. There was lengthy discussion amon~ the Commissioners relating to
the request for lot division, and review of what had been stated at the original
public hearing on this matter.
Motion was made by Comm. Boice and seconded by Comm. Noble to grant the Zone
Variance, and the motion carried by the following vote:

There was further discussion, and a motion was made by Comm. Boice, seconded by
Comm. Reeves, to adopt P.C. Resolution No. 154-605 recommending to the City Council
that said applicant's request for zone variance be granted for the following
reasons:
l. That the granting of this variance does not decrease the lot size, because
if the existing building, which is located across the two lots, is removed, the
applicants then would have two legal lots 25 ft. in width by 90 ft. in depth.
2. The re-division of these lots by making them 50 ft. in width and 45 ft. in
depth is not detrimental to the neighborhood and it is appaeent this will enhance
said neighborhood.
3. Allowing this realignment of lots will in no way increase the density.

is 4000 sq . f t.
3. By downgrading th e land in this ma nner i t i s in c o nf lict with the goals set
forth in ou r Gener a l Pla n for 1985 of very low den s ity res iden tial, 0 t o 15 dwe ll i ng units
per acre, and the General Plan poin ts out t hat this is a prime develo pment area f o r
re sidentia l prop e rty.

was made by Comm. Noble, and seconded by Comm . Arme r , that a l ett er be direc ted
to the City Man ager advising him that the Planning Commi s sion has looke d at this
r e -locat ion of the street and does not f ee l it is in th e bes t interest of t he City
of Hermosa Beac h, and su gges t ing tha t our City En g ineer, Hr. Steven s, be present
at t he mee ting in Redo ndo Be ach on March 16 th, in our behal f to presen t sug gest io ns.

Comm. Armer told the other Commissioners that at the meeting of the Southwest
Area Planning conmittee, guide lines for sign ordinances for the 14 citi e s
within the Southwest area had been established, and literature pertaining this
would be distributed to the Commissioners. He also spoke of a conference
June 15th and 17th, concerning an endeavor at Dominguez State College,
where they are trying to computerize all the data for all the cities involving
such things as zoning, lighting etc.
