A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA BEACH
GRANTING A ZONE VARIANCE UPON CERTAIN PROPERTY LOCATED ON 15 t h STREET
IN THE CITY OF HERMOSA BEACH, CALIFORNIA
THE PLANNING COMMISSION OF THE CITY OF HERMOSA BEACH doe s resol ve as follows:
WHEREAS, th e re was f iled with this Commission under the provisions o f Ordinance
N.S. 15 4, application for zone variance by Thelma an d Karl McMi lien Jr. (owners),
a nd D. K. Haggerty and K. E. Palme r (prospective buyers), to ere ct a 30 unit, 3
story apartment house; all one bedroom apart ments; with 37 garages in lieu of
r e quired 45; la nd area per dwelling unit 447 sq. ft in I ieu required 600 sq. ft;
land cover age 87°/o in li eu required 75%; all ow stairways to encro ach in to east
and west sideyards 20'' i nto required fl ve f t. se tback; rear setback fir st fl oor to
be I ft . from property lin e in l ieu required 3 ft, on that property situated at
33 15th Street; and
WHEREAS, the Plann ing Commission of the City of He rmosa Beach did on Janu ary 8,
1968 and Jan uar y 22, 1968 conduct duly advertised public hearing to consider
this appli cat ion on this p roperty legally de scribed as :
Lot s 19 , 20, l3, 34, 35, block 16, Hermosa Beach t ract; a nd
WHEREAS , alternate, more conforming pro pos al was su bmit ted to th e Planning
Co mmis s ion by the applicants at the adjourned meeting o f January 22, 1968,
NOW, THEREFORE, BE IT RESOLVED that in view o f t he findings at said heari ng,
the Pl a nning Corrmission does hereby gran t zone varianc e to er e ct a 3D unit,
3 story apartmen t house, all o ne bedroom apar tm ents; wi t h 41 garages in li e u of
requ ired 45; land area per dwe lling unit 447 sq. ft . in lieu o f requir e d 600 sq.
ft; land cov erag e 87% in lieu req u ired 75%; allow st airw ays to e ncroach into eas t,
and west sideyards 20 11 into required f!ve f t . setba c k; rear setba c k first floor to
be 2 ft. from property line in lieu req ui red 3 ft., on said property, and for
t he followi ng reason s :
l. Over the past numb e r of year s a number of th e Planning Commissi oners hav e
been advocating a rel i ef to a de ve loper who in tu rn combines lots to gether.
2. The 41 garage spaces in lieu of 45 required, app e ars, according to a s urvey
mad e by the Planni ng Staff, to be equal to or g reater th an the norm for
one bedroom unit s.
J . The land cove rage o f 87% as stated in lieu of t he 75% requir ed, is at th e
ground lev el where the gara ges are locat ed, and t he land cove rage for the
act ual 1 iving area that is availabl e is l ess than the coverage req ui rement
of 75%.

4. The s t airway s do encroach 20 11 into the r e quir e d 5 ft. setback, bu t t he
building its e lf is set ba c k 7 ft . in li e u of 5 ft., and the stair e n
c roa chme nt , a s pre se nted o n the floor plan a t th e gr o u nd l e vel onl y , is not
a major detriment to the r est ri c tion of this 5 ft . s e tback.

fac t t ha t the width of t he garag es h a ve been e xp~nd e d fn tha t area , ma k ing
the t urning radii adequa t e to meet the c riteria of th e existing parking
requir e ments for turning radii now in ef fect in Hermo sa Bea c h.
The forego ing r es oluti o n was adopted by the Planning Commission at an adjourne d
me et ing he ld on t he 22nd day o f January, 1968, by the following vote:
