HomeMy WebLinkAboutPC Resolution 86-21RESOLUTION P.C. 86-21 1 A RESOLUTION OF THE PLANNING COMMISSION OF HERMOSA BEACH, CAL- 2 IFORNIA, RECOMMENDING TO THE CITY COUNCIL TO AMEND CHAPTER 29. 5, 3 SUBDIVISION OF LAND BY ADDING SECTION 29. 5-7 TO ALLOW PLANNED UNIT DEVELOPMENTS (PUD). 4 5 WHEREAS, the Planning Commission held a public hearing on April 1, 1986 and made the following findings: 6 7 A. The City's subdivision ordinance does not provide for the 8 9 10 B . 11 12 13 14 15 16 17 18 C. approval of Planned Unit Developments. The FUD section will allow the creation of lots under 4000 square feet in size and not fronting on a public right of way when common areas, i.e. vehicle access, pedestrian access, open space and any other areas appurtenant thereto cannot be sold or encumbered separately from each individual lot. The intent and purpose of a PUD is to encourage well planned developments. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission 19 of the City of Hermosa Beach, California recommends adding to 20 Chapter 29.5 the following section: 21 Section 29.5-7. Planned Unit Development (PUD) 22 23 A. 24 25 26 27 28 B. Lots less in area and width than the minimum specified within this chapter and not fronting on a public street may be approved when the proposed tentative tract or parcel map fall within the definition of a P.U.D. SUBDIVISION OF LAND AND TRACT MAP REQUIRED --A tentative tract map shall be filed and shall show the precise location and designation of all lots upon which residential dwellings are to be developed; all lots to be owned in commo_n which are designed to be developed and used exclusively for supplemen­ tal ~park i ng a n d v ehicu la r a nd p e de st r i an a ccess fro m a publicly dedic at ed street to ind i v i d t,1 al ly ow ned lots; a n d, all lots to b e own e d in c ommon whic h at e d esi g ned to be own ed l 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 C. in common which are designed to be developed, reserved and used exclusively for open-space and recreational uses. No building permit sh~ll be issued for any lot within the bound­ aries of a Planned Unit Development unless and until a final subdivision tract map has been recorded. A final tract map which deviates from the conditions imposed by the conditions of approval of a tentative tract map shall not be approved for recordation. In regards to division, sale or separation of lots or parcels of land, the following regulations shall apply: 1. DIVISION OF LOTS OR PARCELS --In addition to the in­ form a t ion required to be shown on the tentative and final tract maps, where lots or parcels ofland are to be sold or separated in ownership from other property in the de velopment , or applicable phase the r of, the respec­ tive maps shal 1 also designate the boundaries of the lots or pracels of land to be sold or separated in ownership. 2. SALE OR SEPARATION OF LOTS OR PARCELS --Where lots orparcels of land are sold or otherwise separated in ownership, no dwelling unit or lot or parcel of land for a bulding shall be sold or encumbered separately from an undivided interest in the open-space and the area desig­ nated as common ve hicu lar access appurtenant to such dwelling unit or lot or parcel of land. Such undivided interest shall include either, an undivided interest in the open-space and area designated as common vehicular access, or a share in the corporation or voting member­ ship in an association owni g the open-space and ara designted as common vehicular access. FINAL TRACT MAP --The Title Page of the final recorded Tract Map or Maps, as the case may be, shall contain the following statement pertaini ng to the sale or separation of lots upon which individual building or dwellings are to be developed: 11 No lot in this Tract Map upon which residential dwellings or buildings are to be built, constructed, developed or other­ wise occupied, shall be contracted to sell, sold, granted, deeded, conveyed, title transferred or otberwi ·e separated in ownership, including subsequent heirs a nd owners in inter est, or encumbered separately from an i di vi dual inte rest in lots appurtenant thereto so des i gna ed on this Tract Map for vehicular and pedestrian access, ope space, and any other areas appurtenant thereto". 24 VOTE: 25 AYES: Comms.Peirce, Schulte,Chmn.Sheldon NOES: Comm.Compton 2G ABSENT: Comm.
