A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA
2 11 BEACH, CALIFORNIA, APPROVING A CONDITONAL USE PERMIT FOR BEER AND
WINE AND OUTSIDE DINING AND A NEGATIVE DECLARATION IN CONJUNCTION
3 II WITH A RESTAURANT AT 87 -14TH STREET, BACK BURNER CAFE.
4 WHEREAS, the Planning Commission held a public hearing on
5 11 this matter on November 18, 1986 and made the following Findings:
6 11 1. The proposed project is compatible with applicable General
7 and specific plans;
8 11 2. The proposed project with imposition of Conditions of

Approval is not expected to negatively impact neighboring
residents and properties;
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission
of the City of Hermosa Beach, California, does hereby approve a
Conditional Use Permit for sale of beer and wine and outdoor
dining in conjunction with a restaurant at 87 -14th Street
subject to the following conditions:
17 11 1. Development shall be in substantial conformance with
submitted plans and in conformance with all of the following
conditions; any proposed modification shall be submitted to
the Planning Department for review and approval.

A bicycle rack with at least 10 spaces shall be installed on
the premises.
Seating shall be limited to the maximum number of seats
allowed indoors by the Building Code.
A railing not more than 36 inches high shall be installed
around the outdoor seating area. Plans showi~g location and
materials of the railing shall be submitted to the Planning
Director and approved prior to the issuance of Building
Permits.

Noise emanating from the property shall be within the
limitations prescribed by the City's Noise Ordinance and
shall not create a nuisance to the surrounding residential
neighborhoods, and/or commercial establishments.

public areas such as the public sidewalk and beach.

12. Any violation of the Conditions of Approval and/or violation
of the Hermosa Beach Municipal Code may be grounds for a
public hearing for the revocation of the Conditional Use
Permit.
13. The exterior of the premises shal 1 be maintained in a neat
and clean manner at all times.
14. Any changes to the interior design shal 1 be subject to the
review and approval of the Planning Commission.
15. Prior to a Conditional Use Permit being in effect, the
applicant shall submit to the Planning Department a signed
and notarized "Acceptance of Conditions" form.
16. A Conditional Use Permit shall be recorded with the deed, and
proof of recordation shall be submitted to the Planning
Department.
17. The Planning Commission may review the Conditional Use Permit
and may amend the subject conditions or impose any new
conditions if deemed necessary to mitigate detrimental
effects on the neighborhood resulting from the subject use.
18. Service of alcoholic beverages shall be in an establishment
that operates a full kitchen and provides full menus
(complete lunches and/or dinners, with hot entrees) and the
primary purpose of the estalishment shall be the service of
food.
27 11 19. All alcoholic beverages shall be consumed on the premises; no
alcohol shall be sold as take-out orders. 28
20. Hours of operation shall be limited to 6:30-a.m. to 2:00 p.m.

a. Alcoholic beverages may be served indoors from 8:00 a.m.
to 2:00 p.m.
b. Alcoholic beverages may only be served outdoors from
11:00 a.m. to 2:00 p.m. on Saturdays, Sundays, and State
and Federal holidays only.
c. Full food service shall be available during all hours of
alcoholic beverage service.
s 11 21. This Conditional Use Permit is issued exclusively for and so
long as the premises remains a restaurant which is defined as
having gross sales as fol lows: not less than 65% food, no
more tha n 35% beer and/or wine sales computed monthly. Upon
request at the time the City inspects the books and records
of the applicant, the applicant shall also submit to the City
copies of all records submitted to the State Board of
Equalization for the purposi:s of verifying the applicant's
books and records, with the understanding that these reviews
are confidential.

22. There shall be a six month review upon final approval and
annual reviews thereafter.
12 11 23. Applicant shall apply for and obtain a valid Encroachment
Permit from the City of Hermosa Beach. A complete
application must be filed within 20 days of the final
approval of this Conditional Use Perm it by the app lic ant.
Unless such permit is obtained th e applicant shall not use
the public right-of-way.

24. The applicant shall submit three (3) sets of revised plans to
the Planning Director for approval prior to the issuance of
Building Permits, if any, and/or prior to this Conditional
Use Permit being in effect and therefore, the granting o f the
liquor license.

Conditions Numbers 2, 3, 4, and 9 shall be specifically
shown on revised plans.
Conditions Number 16, 17, and 23 shall be specifically
complied with prior to this Conditional Use Permit being
in effect.
