HomeMy WebLinkAboutPC Resolution 87-081 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION P.C. 87-8 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA BEACH DETERMINING THE LEGAL USE TO BE THREE DWELLING UNITS FOR PROPERTY KNOWN AS 63 9TH STREET AND 58 10TH COURT LEGALLY DESCRIBED AS LOT 24, BLOCK 10, HERMOSA BEACH TRACT. WHEREAS, on January 20, 1987 the Planning Commission held a Public Hearing to receive written and oral testimony regarding the legality of three dwelling units on the subject property; an WHEREAS the Planning Commission determined that the three dwelling units existed on the property prior to 1956 when such units would have been lawful; and WHEREAS testimony was provided that the two dwelling units had been continuously used, therefore preserving the vested right to maintain the nonconforming use. NOW THEREFORE THE PLANNING COMMISSION OF THE CITY OF HERMOSA BEACH DOES HEREBY RESOLVE AS FOLLOWS: 1) The city records shall reflect that the legal use of the property is for three dwelling units. 2) The three units shall be allowed to remain as three units so long as all three units be brought into conformance with current codes, including the structure itself. 3) If the owner decides that he does not wish to bring the building up to current code standards, that only two units be validated as legal and that the third unit be returned to a garage use, and the entire unit will be returned to those standards that are applicable to current non-conforming structures.
