RESOLUTION P.C. 87-23
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA
BEACH, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT AND
NEGATIVE DECLARATION FOR A BEER AND WINE LICENSE IN CONJUNCTION
WITH THE OPERATION OF A RESTAURANT AT 337 PIER AVENUE, KNOWN AS
THAI TOP.
WHEREAS, the Planning Commission held a public hearing on
April 21, 1987 to receive oral and written testimony regarding an
application for a Conditional Use Permit to allow a beer and wine
license for the property at 337 Pier Avenue, legally described as
Lot 21, Hiss Addition Tract, and made the following Findings:
9 A. The proposed project is consistent with the General Plan;

and properties.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission
of the City of Hermosa Beach, California, does hereby approve
a Conditional Use Permit and Negative Declaration for the
on-site sale of beer and wine in conjunction with an existing
restaurant at 337 Pier Avenue subject to the following
conditions:
This Conditional Use Permit shall not be effective, and
therefore, the beer and wine license shall not be issued
until the Planning Director bas determined that the applicant
bas complied with all of the following conditions of
approval.
Development shal 1 be in substantial conformance with
submitted plans and in conformance with all of these listed
conditions; any proposed modifications shall be submitted to
the Planning Department for review and approval.
A trash enclosure shall be constructed to conform with City
Code.
The applicant shall submit three (3) sets of revised plans to
the Planning Department for review and approval. Building
Permit shall not be issued and this Conditional Use Permit
shall not take effect and therefore, the beer and wine
license shall not be issued prior to approval of the plans by
the Planning Department. Revised plans shall include:
Seating in the restaurant shall be limited to 78 patrons.
The service of alcoholic beverages shal 1 be in an
establishment that operates a full kitchen and provides full
menus. The primary purpose of the establishment shall be the

service of food. A restaurant is defined as having gross
sales of a minimum of 65% food and 35% beer and/or wine sales
computed monthly. Upon request the City may request to
review al 1 records submitted to the State Board of
Equalization and verify the applicant's books and records.
It is understood that the review of these records is
confidential.
7. The hours of operation shall be limited to 11:00 A.M. to
10:00 P.M.
8. The establishment shall not adversely affect the welfare of
the residents and/or commercial establishments nearby.
9. The business shall provide adequate management techniques and
supervisorial techniques to prevent loitering, unruliness,
and boisterous activities of patrons outside the business.

Use Permit and shall acknowledge by signature that the
Conditional Use Permit has been read and understood.
11. All alcoholic beverages shall be served in non-throw-away
glass containers, including beer and wine.
12. The Director of Public Safety may determine that a continuing
police problem exists and may require the presence of a
police approved doorman and/or security personnel.
13. Any violation of the conditions of approval and/or violation
of the Hermosa Beach Municipal Code may be grounds for a
public bearing for the revocation of the Conditional Use
Permit.
14. The exterior of the premises shall be maintained in a neat
and clean manner at all times.
15. Any changes to the interior layout shall be subject to review
and approval by the Planning Commission.
16. Prior to a Conditional Use Permit being in effect, the
applicant shall submit to the Planning Department, a signed
and notarized "Acceptance of Conditions II form.
17. A Conditional Use Permit shall be recorded with the deed, and
proof of recordation shall be submitted to the Planning
Department.
18. The Planning Commission may review the Conditional Use Permit
and may amend the subject conditions or impose any new
conditions if deemed necessary to mitigate detrimental
effects on the neighborhood resulting from the subject use.
19. There shall be a six month review (October 20, 1987) of this
Conditional Use Permit.
