HomeMy WebLinkAboutPC Resolution 87-48RESOLUTION P.C. 87-48 1 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA 2 BEACH, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT AND ENVIRONMENTAL NEGATIVE DECLARATION FOR BEER AND WINE IN 3 CONJUNCTION WITH THE OPERATION OF A RESTAURANT AT 233 PACIFIC COAST HIGHWAY, KNOWN AS HABASH CAFE. 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 WHEREAS, the Planning Commission held a public hearing on August 4, 1987 to receive oral and written testimony regarding an application for a Conditional Use Permit to allow a Beer and Wine License for the property at 233 Pacific Coast Highway, legally described as East 74' of Lot 59, Walter Ransom Company's Venable Place Tract, and made the following Findings: A. No addition or expansion of the restaurant structure is proposed; B. Four (4) on-site parking spaces are provided; C. The site is adjacent to a municipal parking lot; D. The proposed project is consistant with the General Plan; E. The project will not negatively impact neighboring residents and properties; NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Hermosa Beach, California does hereby approve a Conditional Use Permit and Environmental Negative Declaration for the on-site sale of beer and wine in conjunction with an existing restaurant at 233 Pacific Coast Highway, subject to the following conditions: 1. This Conditional Use Permit shall not be effective, and therefore, the beer and wine license shall not be issued until the Planning Director bas determined that the applicant has complied with all of the following conditions of approval. 2. Development shall be in substantial conformance with submitted plans and in conformance with all of these listed conditions; any proposed modifications shall be submitted to the Planning Department for review and approval. 27 3. Seating in the restaurant shall be limited to 46 patrons. 28 4. The service of alcoholic beverages shal 1 be in an establishment that operates a full kitchen and provides full menus. The primary purpose of the establishment shall be the service of food. A restaurant is defined as having gross sales of a minimum of 65% food and 35% beer and/or wine sales computed monthly. Upon request the City may request to review al 1 records submitted to the State Board of Equalization and verify the applicant's books and records. It is understood that the review of these records is confidential. 6. The hours of operation shall be limited to 11:00 a.m. to 10:00 p.m. 7. The establishment shall not adversely affect the welfare of the residents and/or commercial establishments nearby. 8. The business shall provide adequate management techniques and supervisorial techniques to prevent loitering, unruliness, and boisterous activities of patrons outside the business. 9. The Director of Public Safety may determine that a continuing pol ice problem exists and may require the presence of a police approved doorman and/or security personnel. 12. Any violation of the conditions of approval and/or violation of the Hermosa Beach Municipal Code may be grounds for a public hearing for the revocation of the Conditional Use Permit. 13. The exterior of the premises including parking areas shall be maintained in a neat and clean manner at all times. 14. Any changes to the interior layout shall be subject to review and approval by the Planning Commission. 15. Prior to a Conditional Use Permit being in effect, the applicant shall submit to the Planning Department, a signed and notarized "Acceptance of Conditions" form. 16. A Conditional Use Permit shall be recorded with the deed, and proof of recordation shall be submitted to the Planning Department. 17. The Planning Commission may review the Conditional Use Permit and may amend the subject conditions or impose any new conditions if deemed necessary to mitigate detrimental effects on the neighborhood resulting from the subject use. -2 - .. . . . 1 2 3 4 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 18. This Conditional Use Permit shall be reviewed in six months (February 2, 1988).
