HomeMy WebLinkAboutPC Resolution 87-51RESOLUTION P.C. 87-51 1 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA 2 BEACH, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT AND AN ENVIRONMENTAL NEGATIVE DECLARATION TO ALLOW THE OFF-SALE OF BEER 3 AND WINE IN CONJUNCTION WITH FLORAL GIFT BASKETS AT 321 PIER AVENUE, KNOWN AS HERMOSA BEACH FLORIST. 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, the Planning Commission held a public hearing on September 1, 1987 to receive oral and written testimony regarding this matter pursuant to applicable law and made the following Findings: A. The applicant proposes to provide off-sale of beer and wine in conjunction with floral gift baskets; No structural changes or expansion of the existing building are proposed; The proposed use is consistent with the Zoning Code and General Plan; NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Hermosa Beach, California does ,hereby approve a Conditional Use Permit and Environmental Negative Declaration for the off-sale of beer and wine in conjunction with the sale of floral gift baskets at 321 Pier Avenue subject to the following conditions: The primary nature of the business shal 1 be floral gift baskets sales. No alcoholic beverage shal 1 be opened or consumed on the premises. This Conditional Use Permit is exclusively for and so long as the premises remain a floral shop. a. Gross sales shall not be less than 80% flowers and/or other non-alcoholic items or not more than 20% alcoholic beverages computed quarterly. b. Gross sales shall be computed based on the retail value of the bottle(s) contained within any gift basket or other floral arrangement. c. Accurate records shal 1 be maintained. Upon notification, City personnel may audit receipt records to verify compliance with this Conditional Use Permit. -1 - "' .. 1 2 3 4 5 6 7 8 9 10 11 4 . 5. 6. 7 . 8. 9. The establishment shall not adversely affect the welfare of residents and/or commercial establishments nearby. The exterior of the premises shall be maintained in a neat and clean manner at all times. Managers and/or clerks shall be made aware of the Conditions of this Conditional Use Permit. a. Managers and/or clerks shall acknowledge by signature that the Conditional Use Permit has been read and understood. Any violations of the Conditions of Approval and/or violations of the Hermosa Beach Municipal Code may be grounds for a public hearing for revocation of this Conditional Use Permit. This Conditional Use Permit is subject to review in 6 months (March 1, 1988).
