RESOLUTION P.C. 88-2 1 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA 2 EACH, CALIFORNIA, APPROVING A VARIANCE TO PROVIDE A THREE FOOT ARAGE SETBACK RATHER THAN THE REQUIRED SEVENTEEN FOOT PARKING ETBACK AND ENVIRONMENTAL NEGATIVE DECLARATION AT 3220 3 OR NINGSIDE DRIVE, LEGALLY DESCRIBED AS LOT 3, BLOCK 123, 4 HAKESPEARE TRACT. 5 WHEREAS, the Planning Commission held a public hearing on 6 anuary 5, 1988 to receive oral and written testimony regarding 7 his matter pursuant to applicable law and made the following 8 indings: 10 11 12 13 14 • 15 16 17 18 • 19 20 • 21 22 23 24 25 26 27 • 28 The applicant is proposing to provide a 3 foot setback rather than the required 17 foot setback; The location of a large mature tree prevents the applicant from providing the seventeen foot setback without removal of the tree; The variance is necessary for the preservation of a substantial property right possessed by other properties in the vicinity in that other neighbouring properties are developed with 2 units; The variance will not be detrimental to surrounding properties; The variance will not adversely affect the General Plan; NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Hermosa Beach, California, does hereby approve a variance to provide a three foot garage setback rather than the required seventeen foot parking setback and Environmental Negative Declaration at 3220 Morningside Drive subject to the following conditions: A deed restriction shall be recorded to prevent the removal of the tree without prior approval from the Planning Director. If the existing tree shall perish or removed, a specimen-size tree shall be location. -1 - shal 1 need to be replaced in it's , 4 5 6 7 8 9 10 11 12 13 14 15 21 22 23 24 25 26 27 28 a. The size and type of tree shall be subject to approval by the Planning Director. The fire hydrant shall be upgraded to Fire Department standards. All Public Works and Fire Department requirements shall be complied with. Three sets of revised plans shall be submitted for approval by the Planning Director. a. Revised plans shall show all parking spaces to maintain the required 23' turning radius. b. Revised plans shall conform to all other planning and zoning requirements. c. Revised plans shall be in substantial conformance to the plans reviewed by the Planning Commission. An "Acceptance of Conditions" form shall be executed and submitted to the Planning Department prior to the issuance of any Building Permits.
