RESOLUTION P.C. 88-5
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA
BEACH, CALIFORNIA, DENYING A VARIANCE TO ELIMINATE REQUIRED OPEN
SPACE AT 40-7TH COURT, LEGALLY DESCRIBED AS THE NORTH 32' OF LOT
20, BLOCK 7, HERMOSA BEACH TRACT.
WHEREAS, the Planning Commission held a public hearing on
January 5, 1988, February 2, 1988 and February 16, 1988 to
receive oral and written testimony regarding this matter pursuant
to applicable law and made the following Findings:
A. The applicant request a variance for a deck that was enclosed
without building permits;
B. The structure had a 150 square foot deck, of which, 110
square feet of the deck has been enclosed;
C. The remaining 40 square feet of deck does not meet the
minimum dimension of 7' to be counted toward open space;
D. The site contains no other open space;
E. Resolution BZA 154-99 allowed the structure to be constructed
with less than the required open space;
F. Board of Building Adjustments Resolution BA 39 allowed the
structure to be constructed with one stairway leading from
the ground level to the third floor in lieu of the required
two exits;
G. The granting of this variance will make the structure more
nonconforming;
H. The property owner is not denied of any substantial property
right possessed by other properties in the vacinity of the
property;
I. Athough the property is small in size, an adequate dwelling
does exist on the property, and a sufficient zone variance
has already been approved.

NOW, THEREFORE, BE IT RESOLVED that the Planning Commission
of the City of Hermosa Beach, California, does hereby deny a
variance to eliminate required open space at 4O-7th Court.

NOES: None
ABSTAIN: None
ABSENT: None
