HomeMy WebLinkAboutPC Resolution 88-302 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION P.C. 88-30 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA BEACH, CALIFORNIA, APPROVING A VARIANCE TO ALLOW A GUEST PARKING SPACE TO BE COUNTED WITHIN A 15.5 FOOT GARAGE SETBACK AREA RATHER THAN THE REQUIRED 17 FEET AND A NEGATIVE DECLARATION AT 1101 VALLEY DRIVE, LEGALLY DESCRIBED AS THE EAST 50' OF LOT 21 AND 22, KNUTSEN TRACT. WHEREAS, the Planning Commission held a public hearing on April 5, 1988 to receive oral and written testimony regarding this matter pursuant to applicable law and made the fol lowing Findings: A. The applicant proposes to provide two guest parking spaces within a 15.5' garage setback rather than the required 17'; B. The applicant is attemping to conform to parking requirements to obtain a building permit for an illegal dwelling unit; C. The site conforms to all zoning and General Plan requirements to allow the second unit; D. The site has a 1.5' strip public right-of-way between the side walk and the property line; a. This 1.5' strip of land, added to the existing 15.5' setback, will provide the equivalent of a 17' setback; E. The variance is necessary for the preservation of a substantial property right possessed by other properties in the vicinty; F. The variance will not be detrimental to the immediate vicinity since the area is primarily multi-family; G. The variance will not conflict with the provisions of the General Plan; NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Hermosa beach, California, does hereby approve a variance to allow a guest parking space within a 15. 5' garage setback subject to the following conditions: -1 - j 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 1. The fire hydrant shall be upgraded pursuant to Fire Department guidelines. 2. Building permits shall be obtained for the following: a. Additional dwelling unit, including added kitchen. b. Fireplace in upper unit. c. Whirlpool tub in upper unit. 3. The required parking spaces shall be maintained clear of all obstructions. 4. The curb cut shal 1 be expanded pursuant to Public Works requirements. 5. The project shall comply with all other planning and zoning requirements. 6. The proposed design shall be in substantial conformance to approved plans. Any modifications are subject to approval from the Planning Director.
