HomeMy WebLinkAboutPC Resolution 88-35' 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION P.C. 88-35 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA BEACH, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT AND TENTATIVE PARCEL MAP #19557 FOR A 2-UNIT CONDOMINIUM PROJECT AT 722 9TH STREET, LEGALLY DESCRIBED AS LOT 24, TRACT 223. WHEREAS, the Planning Commission held a public hearing on May 3, 1988 to receive oral and written testimony on this matter and made the following Findings: A. The map is consistent with applicable general and specific plans; B. The site is located in a General Plan/ Zoning inconsistancy area, however, the development is consistant with the General Plan density requirements; C. The subdivision or type of improvements are not likely to cause serious public health problems; D. The subdivision or type of improvements will not conflict with easements, acquired by the public at large, for access through or use of property within the proposed subdivision; E. Design of the proposed subdivision is compatible and consistent with applicable elements of the City's General Plan, and is compatible with the immediate environment; F. The project will conform to all zoning and condominium criteria and will be compatible with neighboring residential properties; NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Hermosa Beach, California does hereby approve a Conditional Use Permit and Tentative Parcel Map #19557 for a 2-unit condominium project at 722 9th Street subject to the following conditions of approval: 1. The proposed development shall be in substantial conformance with submitted plans; any modifications shall be submitted to the Planning Director for approval. 2. The project shall meet all requirements of the Condominium Ordinance. -1 - , 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 a. Covenants, Conditions, and Restrict ions in compliance with the Condominium Ordinance shall be submitted to the Planning Director for review and approval prior to the issuance of Building Permits. b. Proof of recordation of approved CC&R's shall be submitted to the Planning Director six (6) months after recordation of the Final Map. c. Requirements of Section 7.2-6(G) shall be shown on structural plans and reviewed at the time of Building Department Plan Check. 3. There shall be compliance with all requirements of the Public Works Department and Fire Department. 4. Revised landscape type and quantity Building Permits, Planning Director plans shall be submitted indicating size, of plant materials prior to issuance of any and shall be reviewed and approved by the a. An automatic landscape sprinkler system shall be provided, and shall be indicated on revised plans. 5. Elevations shall be revised identifying all architectural features for review and approval by the Planning Director. a. Precise height shall be reviewed at the time of Building Plan Check, and plans shall be submitted to the satisfaction of the Building Director. 6. A deed restriction shall be recorded indicating the lower level study/bedroom for Unit B will not be rented or otherwise utilized as a seperate dwelling unit; The said lower level bedroom shall contain no cooking facilities; and/orshall not be physically seperated from the remainder of the unit by any building elements other than a conventional bedroom door. 7. Any satellite dish antennas and/or similar equipment shall comply with the requirements of Section 1227 of the Zoning Ordinance. 8. Three (3) copies of plans, including site, elevation, floor and landscape plans, which are consistent with the conditions of approval of this Conditional Use Permit, shall be submitted for review and approval by the Planning Director prior to issuance of any Building Permits. 9. The Conditional Use Permit shall be null and void one and a half years from the date of approval unless Building Permits have been obtained and approval of the Vesting Tentative Tract Map shall become null and void twenty-four months from the date of approval unless the map is f inaled and the project is implemented. The applicant may apply in writing for an extension of time to the Planning Commission prior to the date of expiration of either the C.U.P. and/or the Tenative Tract Map. -2 - 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 10. An "Acceptance of Conditions" form shall be executed and submitted to the Planning Department prior to the issuance of any Building Permits.
