HomeMy WebLinkAboutPC Resolution 88-41, 1 2 ~ ,) 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION P.C. 88-41 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA BEACH, CALIFORNA, APPROVING AN AMENDMENT TO THE CONDITIONAL USE PERMIT ADOPTED BY CITY COUNCIL ON OCTOBER 10, 1978 TO ALLOW THE ADDITION OF A SMALL DANCE FLOOR AT 1334 HERMOSA AVENUE, BESTIE'S. WHEREAS, the Planning Commission held a public hearing on this matter on May 17, 1988 and made the following Findings: 1. The proposed project is compatible with applicable General and specific plans; 2. The proposed project with imposition of Conditions of Approval is not expected to negatively impact neighboring residents and properties; NOW, THEREFORE BE IT RESOLVED that the Planning Commission of the City of Hermosa Beach, California, does hereby approve an Amendment to the Conditional Use Permit adopted by City Council on October 10, 1978 for Besties, to allow the addition of a small dance floor at 1332 Hermosa Avenue subject to the following conditions: 1. The project shall be in substantial conformance with the submitted plan and in conformance with all of the following conditions; any modification shall be submitted to the Planning Director for review and approval. 2. The establishment shall not adversely affect the welfare of residents, and/or commercial establishments nearby. 3. The business shall provide adequate management and supervisory techniques to prevent loitering, unruliness, and boisterous activities of patrons outside the business or in the immediate area. 4. Noise emanating from the property shall be within the limitations prescribed by the City's noise ordinance and shall not create a nuisance to the surrounding residential neighborhoods, and/or commercial establishments. 5. Prior to a conditional use permit being in effect, the applicant shall submit to the Planning Department, a signed and notarized "Acceptance of Conditions" form. 13. The conditional use permit shall be recorded with the deed, and proof of recordation shall be submitted to the Planning Department. 14. No live entertainment shall be provided. Entertainment shall be limited to recorded music. 15. This conditional use permit is exclusively for and so long as the premises remain a restuarant. The business must maintain a food/alcohol sales ratio of 50%. The City shall have the right during business hours upon 15 days notice to inspect the books and records of the applicant to determine gross sales of food and alcohol. The applicant, upon request, shall also submit to the City copies of all records provided to the State Board of Equalization for purposes of determining sales tax. Applicant gives the right to the City to review the records of the State Board of Equalization for the purposes of verifying the applicant's books and records, with the understanding that these reviews are confidential. 16. Alcoholic beverages may be served only during the times when the service of food is available. 17. Maximum permissible occupancy shall be clearly posted at all times and shall not be exceeded at any time. -2 - ' 18. This establishment shall be in compliance with all Building and Fire regulations. 2 19. The maximum hours of operation shall be 11:00 a.m. to 1:30 a.m. daily. 3 20. Any violation of the conditions of approval and/or violation 4 of the Hermosa Beach Municipal Code is grounds for either a fine or a revocation hearing. 5 21. This Conditional Use Permit voids 'Resolution BZA 154-384 6 and supersedes the Conditonal Use Permit adopted by City Council on October 10th 1978 for Besties. 7 22.
