HomeMy WebLinkAboutPC Resolution 88-43~ 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION P.C. 88-43 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA BEACH, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT FOR THE OUTDOOR STORAGE AND RENTAL OF BICYCLES AT 74 14TH STREET, LEGALLY DESCRIBED AS LOT 15, BLOCK 14, HERMOSA BEACH TRACT. WHEREAS, the Planning Commission held a Public Hearing on June 7, 1988 to receive oral and written testimony regarding this matter and made the following Findings; A. Requirement of a conditional use permit and the imposition of conditions will mitigate any problems that may arise in conjuntion with said use; B. All activities in conjuction with the storage and rental of the bicycles will be conducted within an enclosed fence. C. Al 1 stuctures in conjunction with said use are temporary buildings. D. This use is consistent with the zoning ordinance and General Plan. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Hermosa Beach, California, does hereby recommend approval of a Conditional Use Permit to allow the outdoor storage and rental of bicycles at 74 14th Street, legally described as lot 15, block 14, Hermosa Beach Tract, subject to the following conditions: 1. All uses in conjunction with the bicycle rentals shall be conducted within an enclosed fence. a. The fence must be of decorative block or wrought iron along 14th Street and shall be subject to approval from the Planning Director. No grey block walls or chain link fencing will be allowed along 14th Street. b. No barbed wire or razor wire shall be allowed on the fencing. Shepherd hook fencing will be allowed for security purposes. c. The wall or fence shall be a maximum of six feet (6') in height. 2. All fencing and other on-site improvements shall be provided and maintained by the applicant. 3. No bicycles shall be stored or displayed outside of the fence enclosure. a. Quadracycles or other cycles with more than three wheels are prohibited from being ridden on the Strand. a. b. C • d. e. A manager or other business personnel shall clearly inform all customers of the code prohibiting four wheel cycles on the Strand. All manager and other business personnel shall sign a copy of this Conditional Use Permit stating the conditions have been read and understood. Customers renting cycles with four or more wheels shall sign a document stating that they have been informed of the ordinance prohibiting these cycles on the Strand. A sign shall also be posted on site stating that four wheel cycles are prohibited on the Strand. A sign shall be posted on each quadracycle advising they are prohibited on the Strand. 5. There shall only be a maximum of six (6) quadracycles on site available for rental. 6. The applicant shall provide each customer with safety guidelines and a map indicating where bicycles/quadracycles can be ridden. 7. The use of "Sealand" type storage containers is prohibited. a. An elevation plans indicating type of all structures to be used shall be submitted to the Planning Director for review and approval prior to City approval of the lease agreement. 8. All signs must conform to the Hermosa Beach Muncipal Code. a. No signs shall be placed upon public right-of-ways. 9. The hours of operation shall commence at 6:00 a.m. and shall terminate one hour after sunset. 10. The establishment shall not adversely affect the welfare of the residents and commercial establishments nearby. 11. The business shall provide adequate management and supervisory techniques to prevent loitering, unruliness, and boisterous activities of partons within the immediate area. 12. Noise emanating from the property shall be within the limitations prescribed by the City's noise ordinance and shall not create a nuisance to the surrounding neighborhood. 13. The conditional use permit is for the outside storage and rental on bicycles only. All other activities are prohibited. 15. Any changes to the approved layout shall be subject to approval from the Planning Director. 16. Prior to the conditional use permit being in effect, the applicant shall submit to the Planning Director a signed and notarized "Acceptance of Conditions" form. 17. The Planning Commisison may review the conditional use permit and may amend the subject conditions or impose any new conditions if deemed necessary to mitigate detrimental effects on the surrounding neighborhood resulting from the subject use. 18. The Planning Staff shall review the business one month following it's opening for compliance with the Conditional Use Permit.
