HomeMy WebLinkAboutPC Resolution 88-51RESOLUTION P.C. 88-51 1 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA 2 BEACH, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT AND AN ENVIRONMENTAL NEGATIVE DECLARATION TO ALLOW A SNACK SHOP BUSINESS 3 AT 113 HERMOSA AVE. 4 WHEREAS, the Planning Commission held a public hearing on 5 June 21, 1988 to receive oral and written testimony on this matter 6 and made the following Findings: 7 A. The proposed use is compatible with the surrounding 8 neighborhood and is consistent with the General Plan; 9 B. The imposition of conditions of approval shall mitigate any 10 11 significant problems; 12 NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Hermosa Beach, California does hereby approve a 13 Conditional Use Permit and an Environmental Negative Declaration to allow a snack shop business at 113 Hermosa Avenue subject to 14 the following conditions: 15 1. 16 2. 17 18 19 3. 20 21 22 4. 23 24 5. 25 26 6. 27 28 The establishment shall not adversely affect the welfare of residents and/or commercial establishments nearby. There shall be no expansion of the structure and/or business operations. a. Any changes to the interior layout shall be subject to review and approval by the Planning Commission. The business shall provide adequate management and supervisory techniques to prevent loitering, unruliness, and boisterous activities of patrons outside the business or in the immediate area. Only background music may be allowed at this establishment. At no time shall the noise emanating from the property exceed the limits prescribed by the City's noise ordinance. Each manager shall be given a copy of the conditional use permit and shall acknowledge by signature that the conditional use permit has been read and understood. Seating shall be limited to a maximum of six. Any violation of the conditions of approval and/or violation of the Hermosa Beach Municipal Code may be grounds for the issuance of a penalty citation of $50.00 or more for each day the violation exists and/or a public bearing for the revocation of the Conditonal Use Permit. The Planning Commission may review the Conditional Use Permit and may amend the conditions or impose any new conditions if deemed necessary to mitigate detrimental effects. 8 10. There shall be a review of the Conditional Use Permit every six months. g 11.
