HomeMy WebLinkAboutPC Resolution 88-59RESOLUTION P.C. 88-59 1 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA BEACH, CALIFORNIA, APPROVING A VARIANCE TO ALLOW A GARAGE TO 2 ENCROACH INTO THE REQUIRED 17' SETBACK AND ENVIRONMENTAL NEGATIVE DECLARATION AT 20 4TH STREET, LEGALLY DESCRIBED AS THEN' 47.S' 3 OF LOT 8 AND THEW' S' OF THEN' 47.S' OF LOT 9, BLOCK 4, HERMOSA BEACH TRACT. 4 5 WHEREAS, the Planning Commission held a public hearing on June 21, 1988 and July 19, 1988 to receive oral and written 6 testimony regarding this matter pursuant to applicable law and 7 made the following Findings: 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 a. b. c. d. e. f. The applicant proposes to construct a two car garage within 3 feet from the westerly property line rather than the required 17 feet; The lot size is substantially smaller than lots within the immediate vicinity; The only access for vehicles onto the site is from Beach Drive since the lot is located on a walk street; The variance is necessary for the preservation of a substantial property right possessed by other properties in the vicinity since other properties have garages; The variance will not be detrimental to the immediate vicinity since the site presently has no enclosed parking; The variance wi 11 not conf 1 ict with the prov is ions of the General Plan; NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Hermosa Beach, California, does hereby approve a variance to encroach in to the required 17 setback and Environmental Negative Declaration at 20 4th Street subject to the following Conditions: 1. Parking shall be prohibited within the front yard setback since this area is designated for open space. 2. VOTE: a. Revised plans shall show an automatic irrigation system. b. c. d. A minimum of three (3) fifteen gallon trees shall be included in the landscape plans. A thirty six inch (36") wall or fence shall be constructed along Beach Drive and 4th Street to prevent vehicles from parking on the setback/open space area and the public right of way; an encroachment shall be obtained from Public Works Prior Department to installing fence. The landscape area shall be maintained in a neat and clean manner at all times. The required parking spaces shall be maintained clear of all obstructions. All architectural treatment shall be as shown on submitted plans. The project shall comply with all other planning and zoning requirements.
