A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA
2 BEACH, CALIFORNIA, DENYING A VARIANCE TO MAINTAIN BALCONIES WHICH
ENCROACH INTO THE FRONT YARD SETBACK AT 2000 THE STRAND, LEGALLY
3 DESCRIBED AS LOT 1, BLOCK 21, HERMOSA BEACH TRACT.
4 WHEREAS, the Planning Commission held a public hearing on
5 August 16, 1988 and September 6, 1988 to receive oral and written
6 testimony regarding this matter and made the following Findings:

The applicant is requesting a variance to maintain balconies
which encroach into the required front yard setback area;
The balconies were constructed without obtaining building or
encroachment permits;
The front of the existing main structure already encroaches
into the front yard setback;
There are other non-conformities on the site such as lot
coverage and side yard setbacks;
There are no unusual features of size, shape or topography
which justify granting a variance for this property. The
property is rectangular and similar in size and topography to
adjacent properties;
The variance is not necessary to obtain or preserve a
property right possessed by other property owners in the
vicinity since they are also prohibited from constructing
decks which overhang into the required front setback and
public right-of-way;
The variance may be injurious to the general public because
of potential liabilities created from the overhang;
The granting of the variance will not adversely affect the
comprehensive General Plan;

NOW, THEREFORE, BE IT RESOLVED that the Planning Commission
of the City of Hermosa Beach, California, does hereby deny a
1 variance to maintain balconies which encroach into the front yard
setback at 2000 The Strand.
