A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA
2 11 BEACH, CALIFORNIA, DENYING THE APPEAL AND UPHOLDING THE BUILDING
OFFICIALS APPLICATION OF SECTION 306 OF THE ZONING CODE FOR
31 1 PROPERTY LOCATED AT 2930 THE STRAND , LEGALLY DESCRIBED AS THE
SLY 1/2 OF LOT 37 AND ALL OF LOT 38, BLOCK 1, SHAKESPEARE TRACT. 4''

WHEREAS, the Planning Commission held a hearing on August 2,
1988 to receive oral and written testimony regarding this matter
and made the following findings: 7 "

The applicant was issued a building permit for interior
remodeling of the subject structure;
The applicant completely removed the second story and
reconstructed same in violation of the height limitations of
the R-1 zone without authorization;
Section 306 of the zoning code indicates that structures may
not be erected or reconstructed except as allowed in the zone
in which the structure is located;
The building official correctly applied the provisions of the
zoning code in requiring the structure to comply with current
height regulations;
19 11 E. Section 1902 of the zoning code provides that appeals of the
building officials administration of the zoning ordinance
shall be made to the Planning Commission;

NOW, THEREFORE, BE IT RESOLVED that the Planning Commission
of the City of Hermosa Beach, California, does hereby deny the
24 11 appeal and upholds the building officials application of section
306 of the zoning ordinance for the property at 2930 The Strand
and requires that the third floor (second story) of the structure
26 11 on sai~ property be revised to conform to current zoning
regulations.
