2 11 BEACH, CALIFORNIA, APPROVING A VARIANCE TO ENCROACH INTO THE
FRONT YARD SETBACK AT 1522-1524 AND 1530 LOMA DRIVE, LEGALLY
3 li DESCRIBED AS LOTS 11 AND 12, HISS ADDITION TO HERMOSA BEACH TRACT
AND ENVIRONMENTAL NEGATIVE DECLARATION.

WHEREAS, the Planning Commission held a public hearing on
October 4, 1988 to receive oral and written testimony regarding
this matter and made the following Findings:

The applicant is requesting a variance to maintain a 2.39' to
3.26' setback rather than the required five (5) foot setback
for a six (6) unit condominium under construction;
Survey pins were located in error which resulted in the
mislocation of the building; the surveyor assumed a thirty
(30) foot wide street, actual street width is thirty-five
feet (35');
There are unusual features of topography which justify
granting a variance for this property. The property is
located adjacent to a large hillside, therefore, a building
placement closer to the street is desired;
The variance is necessary to obtain a property right
possessed by other property owners in the vie ini ty because
the front setback is "in line" with surrounding structures;
The variance will not be injurious to the general public,
since no portion of the structure encroaches into the public
right-of-way;
The granting of the variance will not adversely affect the
comprehensive General Plan since setback standards are not
addressed in the General Plan;

NOW, THEREFORE, BE IT RESOLVED that the Planning Commission
l l lof the City of Hermosa Beach, California, does hereby approve a
variance to encroach into the front yard setback at 1522-1524 and
2 11 1530 Loma Drive and Environmental Negative Declaration subject to
the following conditions:

1. Three sets of revised plans shall be submitted for approval
4 11 to the Planning Department.

a. Revised plans shall indicate actual setbacks.
b. Revised plans shall conform to all other planning and
zoning requirements.
The applicant shall contact the Public Works Department
regarding placement of a planter which encroaches into the
public right-of-way.
The Hermosa Beach City School hillside located behind the
subject location shall be landscaped.
a. Said landscape shall include the planting of native
flora, e.g., coastal sage, in an attempt to return the
hillside to its natural coastal dune state.
b. A landscape plan shall be submitted to the Planning
Department.
c. A letter shall be obtained from the Hermosa Beach City
School District consenting to the proposed landscaping.
The developer shall prepare a written report detailing how
the error with the location of the survey pins occurred.
No building permit final will be given until the proposed
landscaping has been completed and approved by Planning
Department.
