HomeMy WebLinkAboutPC Resolution 88-96RESOLUTION P.C. 88-96 1 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA 2 BEACH, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT AND TENTATIVE PARCEL MAP #20092 FOR A 2-UNIT CONDOMINIUM PROJECT AT 3 725 NINTH STREET, LEGALLY DESCRIBED AS LOT 19, TRACT 223. 4 WHEREAS, the Planning Commission held a public hearing on 5 November 15, 1988 to receive oral and written testimony on this 6 matter and made the following Findings: 7 A. 8 9 B. 10 11 12 C. 13 14 D. 15 16 E. 17 18 19 F. 20 21 22 G. 23 24 25 26 27 28 The map is consistent with applicable general and specific plans; The site is located within a General Plan/Zoning inconsistency area, however, the development is consistent with the General Plan density requirements; The development shall pose no threat to the public safety and welfare; The subdivision or type of improvements are not 1 ikely to cause serious public health problems; The subdivision or type of improvements will not conflict with easements, acquired by the public at large, for access through or use of property within the proposed subdivision; Design of the proposed subdivision is compatible and consistent with applicable elements of the City's General Plan; The project will conform to all zoning and condominium criteria and will compatible with adjacent residential properties; NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Hermosa Beach, California does hereby approve a Conditional Use Permit and Tentative Parcel Map #20092 for a 2-unit condominium project at 725 9th Street subject to the following conditions of approval: -1 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 1. 2. 3. 4. 5. 6. 7. 8. 9. 10. The proposed development shall be in substantial conformance with submitted plans; any modifications shall be submitted to the Planning Director for approval. The project shall meet all requirements of the Condominium Ordinance. a. Covenants, Conditions, and Restrictions in compliance with the Condominium Ordinance shall be submitted to the Planning Director for review and approval prior to the issuance of Building Permits. b. Proof of recordation of approved CC&R's shall be submitted to the Planning Director within six (6) months after City approval of the Final Map. c. Requirements of Section 7.2-6(G) shall be shown on structural plans and reviewed at the time of Building Department Plan Check. There shall be compliance with all requirements of the Public Works Department and Fire Department. Three (3) copies of a landscaping plan indicating size, type and quantity of plant materials shal 1 be submitted to the Planning Director for review and approval prior to the issuance of Building Permits. a. An automatic landscape sprinkler system shal 1 be provided, and shall be shown on plans. Architectural treatment shall be as shown on submitted plans; any modification are subject to approval by the Planning Director: a. Precise height shall be reviewed at the time of Building Plan Check, and plans shall be submitted to the satisfaction of the Building Director. Any satellite dish and/or similar equipment shall comply with the requirements of Section 1227 of the Zoning Ordinance. Conduit shall be installed in each unit for cable television. Automatic garage door openers shall be provided. An "Acceptance of Conditions" form shall be executed and submitted to the Planning Department prior to the issuance of Building Permits. Three (3) copies of plans, including site, elevation, floor and landscape plans, which are consistent with the conditions of approval of -this Conditional Use Permit, shall be submitted to the Planning Director for review and approval prior to issuance of any Building Permits. -2 - 1 2 3 11. The Conditional Use Permit shall be null and void one and a half years from the date of approval unless Building Permits have been obtained and approval of the Vesting Tentative Parcel Map shall become null and void twenty-four months from the date of approval unless the map is finaled.
