HomeMy WebLinkAboutPC Resolution 89-02• RESOLUTION P.C. 89-2 1 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA 2 11 BEACH, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT AND PARKING PLAN TO ALLOW THE CONSTRUCTION OF A RESTAURANT WITH DRIVE-THRU 3 11 SERVICE AT 1107 PACIFIC COAST HIGHWAY, LEGALLY DESCRIBED AS LOTS 1, 2, 3, AND 4, BLOCK 1, TRACT 6851 AND ENVIRONMENTAL NEGATIVE 4 11 DECLARATION. 5 WHEREAS, the Planning Commission held a public hearing on 6 11 January 3, 1989 to receive oral and written testimony regarding 7 11 this matter and made the following Findings: 811 A. The applicant is proposing to construct a new 2250 sq. ft. 9 10 restaurant with drive-thru service to replace an existing restaurant which also has drive-thru service; 11 11 B. Based on existing parking standards for restaurant use, 23 12 parking spaces are required; 13 I I C. The applicant is proposing to provide 23 parking spaces, 5 of 14 15 which will be located within the proposed drive-thru service area; 16 11 D. This type of restaurant has a large clientele which utilizes 17 drive-thru services; 18 11 E. The drive-thru memu board will have volume controls and will 19 20 be located to face away from any surrounding residential uses; 21 11 F. Lot 4 will require a zone change and General Plan amendment 22 23 to bring the parking lot into conformance; NOW THEREFORE, BE IT RESOLVED that the Planning Commission of 24 11 the City of Hermosa Beach, California, does hereby approve a Conditional Use Permit, Parking Plan, and Environmental Negative 25 11 Declaration at 1107 Pacific Coast Highway subject to the following Conditions: 26 1 . The proposed development shall be in substantial conformance 27 11 with submitted plans. Planning Director and/or Planning Prior to this Conditional Use Permit and Parking Plan becoming effec t ive the applicant shall request a zone change and general plan amendment for Lot 4, Block 1, Tract 6851 from R-2 to C-3 to bring the parking lot into conformance. a. No building permits shall be issued until the zone change and General Plan Amendment become effective. The loudspeaker volume of the drive-thru menu board shall be controlled so as to not create any noise complaints from adjacent residents or business owners. a. Said menu board shall be limited to six feet (6') in height. The applicant shall bear all costs of the construction of any handicapped curb access as required by the Public Works Department. Seating shall be as shown on submitted plans and will be limited to 60 patrons, any modifications are subject to approval of the Planning Director and/or Planning Commission. a. Outside dining shall be prohibited. Parking shall be as shown on submitted plans. a. The entire parking lot shall be illuminated and designed not to produce glare on adjoining property; 1 ight ing shall be reviewed and approved by the Planning Director. b. A total of 18 spaces shall be provided, plus 5 stacked spaces in the drive-thru lane. Three (3) copies of revised landscape plans indicating size, type and quantity of plant materials shall be submitted prior to issuance of any building permits, and shall be reviewed and approved by the Planning Director. a. Revised plans shall show landscaped berm along Pacific Coast Highway to reduce glare from headlights for south bound traffic. b. An automatic landscape sprinkler system shall be provided, and shall be indicated on revised plans. c. Six inch (6") raised concrete curbs shall be provided along the perimeter of all landscaped areas. A lighting plan shall be submitted for approval by the Planning Director. -2 - • 1 a. Outdoor 1 ighting shall be installed to prevent glare into adjacent properties. 9. The exterior of the premises including parking and landscaped 2 11 areas shall be maintained in a neat and clean manner at all times. 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 10. The management shall prevent cars from stacking up on 11th Street or Pacific Coast Highway. If this problem arises, the Planning Commission may review Conditional Use Permit for modifications. 11. The restaurant shall utilize state-of-the-art air emission equipment to reduce odors. 12. An "Acceptance of Condition" form shall be executed and submitted to the Planning Department prior to the issuance of building permits. 13. The Planning Commission may review this Conditional Use Permit and Parking Plan and may change or modify any conditions to mitigate any problems which may develop.
