HomeMy WebLinkAboutPC Resolution 89-15} ., 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION P.C. 89-15 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA BEACH, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT AND ENVIRONMENTAL NEGATIVE DECLARATION TO ALLOW OFF-SALE BEER AND WINE AT 50 PIER AVE, KNOWN AS PIER MARKET. WHEREAS, the Planning Commission held a public bearing on February 21, 1989 to receive oral and written testimony regarding an application for a Conditional Use Permit to allow off-sale beer and wine for the property at 50 Pier Avenue, legally described as lots 9 and 10, Block 12, Hermosa Beach Tract, and made the following Findings: A. The business is an existing nonconforming alcohol establishment, which is licensed already by the Alcohol Beverage Control Agency; B. The business is attempting to comply with City Council Ordinance No. 86-865, entitled Nonconforming alcohol establishments, on and off sale; C. No expansion is proposed; D. Strict compliance with the conditions of approval will mitigate any negative impact resulting from the issuance of the conditional use permit. E. The proposed project is consistant with the General Plan; NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Hermosa Beach, California does hereby approve a Conditional Use Permit and Environmental Negative Declaration to allow off-sale of beer and wine at 50 Pier Avenue, subject to the following conditions: -1 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 1. Alcohol beverages shall only be sold to individuals over the age of 21 years old. a. Determination of age shall be conducted before the sale of any alcohol beverage. b. Signs shall be clearly and conspicuously posted on all display cases and shelves stating, "Must be at least 21 years of age to purchase alcohol beverages." c. Any violation of this condition shall result in an immediate citation, and C.U.P. revocation hearing. 2. Measures shall be taken to control loitering and littering on the premises at all times. 3. Signs shall be posted in a conspicuous location warning patrons of the illegality of open alcohol containers in any public areas such as the public sidewalk and beach. 4. The Sign Ordinance shall be strictly enforced. a. All signage in windows shall also be subject to and comply with the Hermosa Beach Sign Ordinance and State Code requirements, and the beer and/ or wine s ignage shal 1 be restricted to twenty percent (20%) of all permanent display signs. 5. The establishment shall not adversely affect the welfare of residents, and/or commercial establishments nearby. 6. The business shall provide adequate management and supervisory techniques to prevent loitering, littering, unruliness, and boisterous activities of patrons outside the business or in the immediate area. 7. An employee who is aware of conditions of the conditional use permit shall be on the premises during business hours. 8. 9. a. All employees shall be given a copy of the conditional use permit and shall acknowledge by signature that the conditional use permit has been read and understood. Any changes to the interior design shall be subject to review and approval by the Planning Commission. 12. The applicant will submit to the planning staff an updated interior plan drawn to scale. 13. Prior to the conditional use permit being in effect, the applicant shall submit to the planning department, a signed and notarized "Acceptance of Conditions" form. 14. The conditional use permit shall be recorded with the deed, and proof of recordation shall be submitted to the planning department. 15. The Planning Commission may review the conditional use permit and may amend the subject conditions or impose any new conditions if deemed necessary to mitigate detrimental effects on the neighborhood resulting from the subject use. 16. This conditional use permit shall be reviewed every six months.
