HomeMy WebLinkAboutPC Resolution 89-331 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION P.C. 89-33 A RESOLUTION TO THE PLANNING COMMISSION OF THE CITY OF HERMOSA BEACH, CALIFORNIA, RECOMMENDING APPROVAL OF A TEXT AMENDMENT TO THE ZONING ORDINANCE TO DELETE VIDEO SALES AND RENTALS, IN THE C-1 AND C-2 ZONES, NEIGHBORHOOD COMMERCIAL AND RESTRICTED COMMERCIAL AND APPROVING AN ENVIRONMENTAL NEGATIVE DECLARATION. WHEREAS, the Planning Commission held a public hearing on April 18, 1989 to receive oral and written testimony on this matter and made the following Findings: A. Video sales and rentals of the "X" rated type are not similar in intensity to other uses within the C-1 and C-2 zones; B. A video sales and rental use will have a negative effect on other businesses in the C-1 and C-2 zones and/or adjacent uses if X-rated tapes are included; C. The City is preempted from banning X-rated videos when they are not the predominant use; NOW, fflEREFORE, BE IT RESOLVED that the Planning Commission of the City of Hermosa Beach, California, does hereby recommend that the City Council make the following text amendment to the Zoning Ordinance and approve an Environmental Negative Declaration. SECTION 1. Amend the C-1, Neighborhood Commercial Zone Permitted Use List, Section 8-2, to eliminate the following: VOTE: "Videocassette tape sales and rentals, except Adult, 11 X" rated type; Conditional Use Permit required subject to Section 10-2."
