RESOLUTION P.C. 89-37
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA
BEACH, CALIFORNIA, APPROVING VARIANCES TO ALLOW THE CONSTRUCTION
OF A NEW SUBSTANDARD GARAGE AND SECOND STORY ADDITION WHICH
ENCROACHES INTO THE REQUIRED 17 FOOT SETBACK BEHIND GARAGES AND
INTO THE REQUIRED SIDE YARD SETBACK AND AN ENVIRONMENTAL NEGATIVE
DECLARATION AT 2007 CIRCLE AVENUE, LEGALLY DESCRIBED AS LOT 12
TRACT 3853
WHEREAS, the Planning Commission held a public hearing on
May 2, 1989 to receive oral and written testimony regarding an
application for a Variance to allow the construction of a new
garage and second story addition which encroaches into the
required 17 foot setback and an environmental negative
declaration at 2007 Circle Avenue, Legally described as lot 12
Tract 3583 and made the following Findings:
A. The Applicant is requesting a variance to construct a
substandard two-car garage which will provide space for two
cars, will replace an existing garage which encroaches into
the public right-of-way, and wi 11 al low for a second story
addition with deficient side yard setbacks, while maintaining
the integrity of an older house which is in excellent
condition;
B. The subject property is a relatively small corner lot,
triangular in shape, and is on a moderate slope which
justifies the granting a variance from parking standards and
side yard setbacks because alternative plans which maintain
the integrity of the existing house are not available on this
unusually shaped property;
C. The variance is necessary to obtain or preserve a property
right possessed by other property owners in the area.

D. The variance will not be detrimental to the general public
since required parking will be provided for the proposed
structure;
E. The granting of the variance will not adversely affect the
General Plan.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission
of the City of Hermosa Beach, California does hereby approve
the variances to allow a substandard garage, encroachment
into the 17 foot setback, and encroachment into the sideyard
setback at 2007 Circle Avenue.
