RESOLUTION P.C. 89-39
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA
BEACH, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT AND
ENVIRONMENTAL NEGATIVE DECLARATION TO ALLOW THE SALE OF BEER AND
WINE IN CONJUNCTION WITH A RESTAURANT KNOWN AS ROSA I S AT 322
PACIFIC COAST HIGHWAY.
WHEREAS, the Planning Commission held a public hearing on
May 16, 1989 to receive oral and written testimony regarding an
application for a Conditional Use Permit to allow the sale of
beer and wine in conjunction with a restaurant at 322 Pacific
Coast Highway, legally described as the westerly 70 feet of lots
14 & 15, Hurd's Ocean View Tract and made the following Findings:
A. The proposed beer and wine sales will be conducted in an
existing restaurant in conjunction with an existing food
service;
B. The proposed use is compatible with surrounding uses;
C. Strict compliance with the conditions of approval will
mitigate any negative impact resulting from the issuance of
the conditional use permit;
D. The proposed project is consistant with the General Plan.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission
of the City of Hermosa Beach, California, does hereby approve a
Conditional Use Permit and Environmental Negative Declaration to
allow the sale of beer and wine in conjunction with a restaurant
at 322 Pacific Coast Highway, subject to the following
conditions:
1. The service of alcoholic beverages shal 1 be in an
establishment that operates a full kitchen and provides full
menus. The primary purpose of the establishment shall be the
service of food. A restaurant is defined as having gross
sales of a minimum of 65% food and a maximum of 35% beer or
wine sales computed monthly. Upon request the City may
request to review all records submitted to the State Board of
Equalization and verify the applicant's books and records.
It is understood that the review of these records is
confidential.

2. The hours of operation shall be limited to 11:00 A.M. to
12: 00 P .M. Sunday through Thursday, and 11: 00 A. M. to 2: 00
A.M. Friday and Saturday.
3. The existing parking area located behind the restaurant shall
be striped to clearly identify parking spaces. Signs shall
be posted indicating that the parking spaces are for patrons
and employees of the business on the property. A vehicle
guard rail or poles shall be installed along the edge of the
house located behind the restaurant to prevent vehicles from
colliding with the residential structure. A plan showing the
parking layout in this parking area shall be submitted to and
approved by the Planning Director prior to striping the
parking spaces.
4. Landscaping shall be provided and maintained along the full
length of the planter located in front of the building along
the sidewalk.
5. The existing wall sign which reads "Rosa's Natural Juices"
shall be removed. Any replacement or change of the sign to
correct the name shall be subject to the City's sign
requirements.
6. The Sign Ordinance shall be strictly enforced.

13. Prior to the conditional use permit being in effect, the
applicant shall submit to the planning department, a signed
and notarized "Acceptance of Conditions" form.
14. The Planning Commission may review the conditional use permit
and may amend the subject conditions or impose any new
conditions if deemed necessary to mitigate detrimental
effects on the neighborhood resulting from the subject use.
