RESOLUTION P.C. 89-40
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA
BEACH, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT AND
VESTING TENTATIVE PARCEL MAP 4120804 FOR A 2-UNIT CONDOMINIUM
PROJECT AT 235 MANHATTAN AVENUE, LEGALLY DESCRIBED AS LOT 22,
TRACT 1076.
WHEREAS, the Planning Commission held a public hearing on May
16, 1989 to receive oral and written testimony on this matter and
made the following Findings:
A. The map is consistent with applicable general and specific
plans;
B. The site is zoned R-3 and is physically suitable for the type
and density of the proposed development;
C. The development shall pose no threat to the public safety and
welfare;
D. The subdivision or type of improvements are not likely to
cause serious public health problems;
E. The subdivision or type of improvements will not conflict
with easements, acquired by the public at large, for access
through or use of property within the proposed subdivision;
F. Design of the proposed subdivision is compatible and
consistent with applicable elements of the City's General
Plan;
G. The project will conform to all zoning and condominium
criteria and will be compatible with adjacent residential
properties;
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission
of the City of Hermosa Beach, California does hereby approve a
Conditional Use Permit and Vesting Tentative Parcel Map 4120804
for a 2-unit condominium project at 235 Manhattan Avenue subject
to the following conditions of approval:

1. A zoning analysis shall be prepared and approved by the
Planning Director for the revised plans submitted on May 11,
1989, to ensure conformance with the zoning ordinance.
Building plans shall not be accepted for plan check until
such approval by the Planning Director.
2. The proposed development shall be in substantial conformance
with submitted plans received May 11, 1989; any modifications
shall be submitted to the Planning Director for approval.
3. The project shal 1 meet al 1 requirements of the Condominium
Ordinance.

Covenants, Condit ions, and Restrict ions in compliance
with the Condominium Ordinance shall be submitted to the
Planning Director for review and approval prior to the
issuance of Building Permits.
Proof of recordation of approved CC&R's shall be
submitted to the Planning Director within six (6) months
after City approval of the Final Map.
Requirements of Section 7.2-6(G) shall be shown on
structural plans and reviewed at the time of Building
Department Plan CPeck.
4. There shall be compliance with all requirements of the Public
Works Department and Fire Department.
5. Three (3) copies of a landscaping plan indicating size, type
and quantity of plant materials shall be submitted to the
Planning Director for review and approval prior to the
issuance of Building Permits.

An automatic landscape sprinkler system shall be
provided, and shall be shown on plans.
The raised planters within the front yard setback area
shall be limited to 36".
6. Architectural treatment shall be identified on building
elevations and shall be subject to approval by the Planning
Director:
a. Precise height shall be reviewed at the time of Building
Plan Check, and plans shall be submitted to the
satisfaction of the Building Director.
7. Any satellite dish and/or similar equipment shall comply with
the requirements of Section 1227 of the Zoning Ordinance.
8. Conduit shall be installed in each unit for cable television.
9. Automatic garage door openers for roll-up garage doors shall
be provided.

10. The address of each condominium unit shall be conspicuously
displayed on the front street side of the building with
externally or internally lit numbers.
11. The street name "Manhattan Avenue" shall be displayed with
the address number for the unit facing the alley street to
the rear of the property.
12. Three (3) copies of plans, including site, elevation, floor
and landscape plans, which are consistent with the conditions
of approval of this Conditional Use Permit, shall be
submitted to the Planning Director for review and approval
prior to issuance of any Building Permits. Said plans shall
clearly indicate the location of the required 200 cubic feet
of enclosed, lockable, storage area adjacent to the garage.
13. An "Acceptance of Conditions" form shall be executed and
submitted to the Planning Department prior to the issuance of
Building Permits.
14. The Conditional Use Permit shall be null and void one and a
half years from the date of approval unless Building Permits
have been obtained and approval of the Vesting Tentative
Parcel Map shall become null and void twenty-four months from
the date of approval unless the map is finaled. The
applicant may apply in writing for an extension of time to
the Planning Commission prior to the date of expiration.
