HomeMy WebLinkAboutPC Resolution 89-442 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION P.C. 89-44 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA BEACH, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT AND ENVIRONMENTAL NEGATIVE DECLARATION TO ALLOW THE SALE OF BEER AND WINE IN CONJUNCTION WITH A RESTAURANT KNOWN AS LA PENITA II AT 200 LONGFELLOW AVENUE. WHEREAS, the Planning Commission held a public hearing on June 6, 1989 to receive oral and written testimony regarding an application for a Conditional Use Permit to allow the sale of beer and wine in conjunction with a restaurant at 200 Longfellow Avenue, legally described as lot 2, Block 118, Shakespeare Tract and made the following Findings: A. The proposed beer and wine sales wi 11 be conducted in an existing restaurant in conjunction with an existing food service; B. The proposed use is compatible with surrounding uses; C. Strict compliance with the conditions of approval will mitigate any negative impact resulting from the issuance of the conditional use permit; D. The proposed project is consistant with the General Plan. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Hermosa Beach, Ca 1 i forn ia does hereby approve a Conditional Use Permit and Negative Declaration to allow the sale of beer· and wine in conjunction with a restaurant at 200 Longfellow Avenue subject to the following conditions: 1. The service of alcoholic beverages shal 1 be in an establishment that operates a full kitchen and provides full menus. The primary purpose of the establishment shall be the service of food. A restaurant is defined as having gross sales of a minimum of 65% food and a maximum of 35% beer or wine sales computed monthly. It is understood that the review of these records is confidential. 2. The hours of operation shall be limited to 9:30 A.M. to 10:00 P.M. Sunday through Thursday, and 9:30 A.M. to 11:30 P.M. on Fridays and Saturdays. No consumption of alcohol or serving of food shall be allowed on the patio area except between the hours of 9:30 A.M. and 4:00 P.M. 3. The existing wooden fence enclosing the patio area shall be repaired and maintained in an attractive condition. 4. The adjacent garage shall be used for vehicle parking only, and the partition shall be removed. No use or storage of noxious substances shall be permitted inside said garage. 5. The Planning Commission may review the conditional use permit and may amend the subject conditions or impose any new conditions if deemed necessary to mitigate detrimental effects on the neighborhood r esul t ing from the subject use.
