HomeMy WebLinkAboutPC Resolution 89-751 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 ,__,, 27 28 t RESOLUTION P.C. 89-75 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA BEACH, CALIFORNIA, DENYING AN AMENDMENT TO CONDITIONAL USE PERMIT, VARIANCE, AND PARKING PLAN TO ALLOW AN ADDITIONAL AWNING TO AN EXISTING CAR WASH/GAS STATION AT 1000 PACIFIC COAST HIGHWAY, LEGALLY DESCRIBED AS LOT 60, 61, 102, 108, BLOCK 5650 WHEREAS, the Planning Commission held a public hearing on October 3, 1989 to receive oral and written testimony regarding an application for an amendment to conditional use permit, variance, and parking plan at 1000 Pacific Coast Highway and made the following findings for denial: A. The applicant is not proposing a means of providing additional off-street parking spaces required for the awning and the existing building, currently nonconforming to the parking requirements; B. The proposed addition is encroaching into the 8-foot setback required for commercial buildings by 100 percent, and is also in violation of the Building Code; C. The proposed encroachment is not compatible with the intent of the setback requirements between commercial and residential zones and could create a nuisance for adjacent residential development; D. A variance is not necessary to preserve a substantial property right possessed by other properties in the vicinity; E. The deletion of off-street parking would be potentially detrimental to neighboring properties by forcing employees to park in the adjacent neighborhood; F. There are no unique features which result in a hardship to -1 - T 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 '---.../ 27 28 developing the property according to the zoning and building ordinances; NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Hermosa Beach, California, does hereby deny the amendment to the conditional use permit, the variance, and the parking plan to al low an aluminum awning enc roa ching into the setback without the provision of additional off-street parking spaces.
