HomeMy WebLinkAboutPC Resolution 89-89( \ 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION P.C. 89-89 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA BEACH, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT AMENDMENT AND REPEALING PARKING PLAN RESOLUTION NO. 87-2 TO ALLOW THE MODIFICATION OF AN EXISTING USED AUTO DEALERSHIP AND MODIFY THE PARKING REQUIREMENTS ON THE SUBJECT PROPERTY, AT 840 PACIFIC COAST HIGHWAY LEGALLY DESCRIBED AS LOTS l, 2, AND LOT 9, TRACT 8386. WHEREAS, the Planning Commission held public hearings on December 5, 1989, to receive oral and written testimony regarding an application for an amendment to Conditional Use Permit at 840 Pacific Coast Highway and made the following findings: A. The applicant is proposing to limit the Casey's new and used auto sales and new car services to only used car sales in the existing building previously used for Isuzu Auto Dealership which decreases the intensity of the use; B. The proposed use is compatible with the surrounding area and consistent with the General Plan and Zoning Ordinance; C. The imposition of conditions will mitigate any significant impacts associated with the proposed use; D. The site is adequate in size, and provides sufficient parking areas to provide the required parking spaces, and the existing use is consistent with surrounding commercial activities along Pacific Coast Highway, and is consistent with the General Commercial General Plan designation; NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Hermosa Beach, California does hereby approve a Conditional Use Permit to approve the modification of an existing used-car sales, subject to the following conditions: 1. The location of structures and features on the property shall be in substantial conformance with submitted plans as revised in accordance with the conditions below; any modification shall be submitted to the Planning Director for approval. -1 - 1 2 3 4 5 6 7 8 9 10 11 12 13 / 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 2. The applicant shall keep ten (10) parking spaces, shown on the revised site plan, available and accessible to employee and customer use. a. All parking spaces shall be properly striped with appropriate signs posted indicating that the spaces are for employee and customer use only. b. No vehicle for sales shall be parked in the required parking spaces. c. All parking areas shall be maintained free of unregistered and derelict vehicles. d. Al 1 employees I vehicles and for-sale vehicles shal 1 be parked on-site. e. Parking or storage of recreational vehicles (R. V.) shall be strictly prohibited. f. Three parking spaces inside the bays shall be maintained for employee parking space only, and shall not be used for detailing and other similar activities. 3. The public right-of-way shall not be used for the parking or storing of vehicles that are intended for sale, detailing, or other purposes. 4. Test driving of vehicles on local residential streets shall be prohibited. 5. Landscaping shall be provided along the Pacific Coast Highway frontage, to enhance aesthetic attributes of the site, and to direct drainage directly into the storm drains rather than across the public sidewalk. 6. There shall be a sign posted in the sales office directing the customers to the route, approved by the Planning Director, which may be used for test driving. 7. All outdoor work activities shall be prohibited. 8. All exterior lighting shall be oriented in a manner to avoid glare to neighboring residences. 9. Exterior phone bells, buzzers, public address systems, or similar devices, which are audible to adjacent properties, shall be prohibited. 10. The car-lift shall not exceed 3 feet in height and a maximum of one shall be allowed. 11. Repair, service, and maintenance of vehicles shal 1 not be conducted on the premises. 12. Storage of trucks, tractors, trailers, and RVs in the parking and car display areas or any other location on the premises shall be prohibited. -2 - 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 13. Noise emanating from the property shall be within the limitations prescribed by the City's noise ordinance, Article 19.5 of Hermosa Beach Municipal Code, and shall not create a nuisance to the surrounding residential neighborhood and commercial establishments. Creating loud or obnoxious noise shall be prohibited. 14. Examination of car alarm systems shall be conducted indoors. 15. The exterior of the premises including the parking areas shall be maintained in a neat and clean manner at all times. 16. Prior to the Conditional Use Permit being in effect, the applicant shall submit to the Planning Department, a signed and notarized "Acceptance of Conditions" form. 17. The Conditional Use Permit shall be recorded with the deed, and proof of recordation shall be submitted to the Planning Department. 18. The Planning Commission may review this Conditional Use Permit and may amend the subject conditions or impose any new conditions if deemed necessary to mitigate detrimental effects on the neighborhood resulting from the subject use. 19. There shall be a review of this Conditional Use Permit in 6 months. 20. The applicant shall submit two (2) copies of a revised site plan for review and approval by the Planning Director which are clearly in compliance with all conditions of approval, and indicate the landscape area, adequate drainage, and location of the car-lift. 21. This Resolution supersedes Resolutions 87-2, P.C. 87-30, and P.C. 87-32. 22. All employees shall be given a copy of the conditional use permit and shal 1 acknowledge by signature that the conditional use permit has been read and understood.
