HomeMy WebLinkAboutPC Resolution 84-19RESOLUTION P.C. 84-19 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA BEACH RECOMMENDING TO THE CI'TY COUNCIL TO AMEND SECTIONS 1301, l 1302, 1304 and 1309 OF THE ZONING ORDINANCE . 2 WHEREAS, the Planning Commission held a public hearing on July 31 1 3 1984; and 4 WHEREAS, the Planning Commission has reviewed the initial study 5 and has determined there are no significant adverse environmental 6 impacts created by this project and recommends that a negative 7 declaration be filed with the County Recorder; and 8 WHEREAS, a goal o! the Housing Element o! the General Plan is to 9 preserve and rehabilitate the existing housing stock; and 10 WHEREAS, the current zoning ordinance provisions relating to 11 additions and alteration o! existing nonconforming residential 12 structures are restrictive and discourage rehabilitiation of those 13 structures. 14 NOW, THEREFORE, the Planning Commission o! the City of Hermosa 15 Beach does hereby resolve to recommend revisions to the Zoning 16 Ordinance as follows: 17 1. An exception shall be added to Section 1301 to read, 18 19 20 21 22 "Exception 1) Residential uses may be expanded or structurally altered provided the expansion or alteration complies with the regul~tions o! the zone in which the use is located. Where the residential use located in a "C 11 or "M" zone, any expansion shall comply with the R-3 regulations," 23 2, Section 1302 shall be amended to read "The nonconforming 24 25 26 27 28 use o! a nonconformi :q,: building may be continued, p ·rovided such nonconforming use shall not be expanded or extended nor shall any st-urcutral alterations be made e'.Xcept those required by law, I! such nonconforming use is vacated or discont ;i:.nueo. !or ninety ( 90) consecut f ,ve days or more, any r-~ 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 3. 4. future use of such building shall conform to the provisions of the zone in which it is located. Exception 1) Residential uses may be expanded or structurally altered provided the expansion or alteration complies with the regulations of the zone in which the use is located. Where the residential use located in ·a "C" or "M" zone, any expansion shall comply with R-3 regulations." Section 1304 shall be omitted. Section 1309 shall be retitled and amended to read 1 "Section 1309 Existing Nonconforming Structures Existing structures which are nonconforming as to yards, lot coverage, open space or height may be expanded or enlarged provided the expansion or enlargement complies with the regulations o;f the zone in which the structure is located. Existing nonconforming sideyards may be maintained.with an -; addition provided the sideyard is not more than 10% smaller than the current sideyard required." 18 VOTE: AYES : Chmn. Izant, Comm.
