A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA
BEACH, CALIFORNIA, APPROVING A VARIANCE FROM THE GUEST PARKING
REQUIREMENT, AND A REQUEST, PURSUANT TO SECTION 13-7 (B) OF THE
ZONING ORDINANCE, TO CONSTRUCT AN ADDITION TO A NONCONFORMING
STRUCTURE WHICH EXCEEDS 50% OF THE REPLACEMENT VALUE OF THE
EXISTING STRUCTURE, AND ADOPTION OF A NEGATIVE DECLARATION AT
1419 MONTEREY BOULEVARD, AND LEGALLY DESCRIBED AS LOT 31, BLOCK
49, 2ND ADDITION TO HERMOSA BEACH TRACT.
WHEREAS, the Planning Commission held a public hearing on
February 6, 1990, to receive oral and written testimony regarding
an application for a Variance, and an exception, pursuant to
Section 13-7(B), to allow more than a 50% addition to a
nonconforming structure, and made the following findings:
A. The applicant is proposing to construct a second story
addition to an existing single-family structure and the
addition of a second dwelling unit above an existing
nonconforming garage, which results in an addition equivalent
to 95% of the replacement value of the existing structure,
and is proposing expanding the available parking spaces from
two spaces to four spaces;
B. The zoning ordinance requires two spaces per unit plus one
guest space, a total of five parking spaces, for a two-family
dwelling unit;
C. There _ are exceptional circumstances related to the physical
conditions of the subject property because of its 10% slope,
and the existing mature 16" pine tree, which make the
provision of required parking a hardship, and result in the
destruction of the tree if required parking were provided;
D. Other alternatives available to the applicant for providing

required parking would likely require complete redevelopment
of the property;
E. The property is zoned R-3 and could otherwise be developed
with a 3-unit condominium, which would likely have a more
detrimental impact on the surrounding neighborhood than the
expansion of the existing structures;
F. The structural second story additions equivalent to 95% of
the replacement value of the existing structure are
consistent with Section 13-0 of the zoning ordinance

NOW, THEREFORE, BE IT RESOLVED that the Planning Commission
of the City of Hermosa Beach, California does hereby approve a
Variance, and an exception, pursuant to Section 13-7(B) of the
zoning ordinance, to allow more than a 50% addition to an
existing nonconforming structure and a Negative Declaration at
1419 Monterey Boulevard subject to the following conditions:
1. The proposed development shall be in substantial conformance
with submitted plans, revised as noted below, and any
modifications shall be submitted to the Planning Director
review and approval.
2. Three copies of revised plans shall be submitted for review
and approval to the Planning Director prior to the issuance
of building permits addressing the following:
a. A minimum of 100 square feet of private open space shall
be provided for unit B.
b. The stairway accessing unit B shall be set back a minimum
of 4-feet from the side property line.
c. The "family room" of the unit over the garage shall be
re-designed to eliminate the potential of a second
bedroom.
3. The applicant shall submit a termite and dry rot inspection,
to the satisfaction of the Building Director, to verify that
the existing structure is in satisfactory condition to
support the proposed additions without requiring any
demolition or reconstruction of the existing structure, prior
to the issuance .of building permits.

4. A m1n1mum of four parking spaces shall be continuously
available on the property.
S. A deed restrict ion, with the City a party thereto,
restricting the use of the property to two stories and a
maximum of two units shall be recorded with the deed. Proof
of recordation shall be submitted to the Planning Department.
