A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA
BEACH, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT AND A
TENTATIVE PARCEL MAP #21160 FOR A 2-UNIT CONDOMINIUM AND
APPROVING A VARIANCE TO ALLOW A TWO (2) FOOT SIDE YARD SETBACK
RATHER THAN THE REQUIRED FOUR (4) FEET AND THE ADOPTION OF AN
ENVIRONMENTAL NEGATIVE DECLARATION FOR 333 10TH STREET, LEGALLY
DESCRIBED AS THE EASTERLY 40 FEET OF LOTS 23 & 24, TRACT 1516.
WHEREAS, the Planning Commission held a public hearing on
March 20, 1990 to receive oral and written testimony regarding
an application for a Conditional Use Permit and Variance at 333
10th Street and made the following findings:
A. The map is consistent with applicable general and specific
plans;
B. The site is zoned R-3 and is suitable for the type and
density of the proposed development;
C. The development shall pose no threat to the public safety and
welfare;
D. The subdivision or type of improvements are not likely to
cause serious public health problems;
E. The subdivision or type of improvements will not conflict
with easements, acquired by the public at large, for access
through or use of property within the proposed subdivision;
F. Design of the proposed subdivision is compatible and
cons is tent with applicable elements of the City's General
Plan;
G. The variance is justified because of the exceptional
circumstances in the unusually small lot size and shallow
depth for a 2-unit site which limits the alternatives for
providing required parking on the site;
H. The best available alternative for providing parking results
in the encroachment into the side yard which preserves a
substantial property right possessed by other properties of

similar size and shape in the vicinity and zone of the
property;
I. The variance will not be materially detrimental to the public
welfare or injurious to the property or improvement in the
vicinity as the 2-foot encroachment is only 19-feet wide and
6-feet above grade;
J. Other than the 2-foot encroachment, the project will conform
to all zoning and condominium criteria and as conditioned
will be compatible with adjacent residential properties;
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of
the City of Hermosa Beach, California, does hereby approve a
Conditional Use Permit and Tentative Parcel Map /121160 for a
2-unit condominium project, approve a variance, and adopt an
environmen tal negative declaration for 333 10th Street subject to
the following conditions:
1. The proposed development shall be in substantial conformance
with submitted plans.
2. The project shall meet all requirements of the Condominium
Ordinance.
a. Covenants, Conditions, and restrictions in compliance with
the Condominium Ordinance shall be submitted to the
Planning Director for review and approval prior to the
issuance of Building Per mit.
b. Proof of recordation of approved CC&R shall be submitted
to the Planning Director within six (6) months after City
approval of the Final Map. •

3. There shall be compliance with all requirements of the Public
Works Department and Fire Department.
4. Three (3) copies of a landscaping plan indicating size, type,
and quantity of plant materials shall be submitted to the
Planning Director for review and approval prior to the
issuance of Building Permit.
a. An automatic landscape sprinkler system shall be provided,
and shall be shown on plans.
5. Architectural treatment shall be as shown on building
elevations and any modification shall require approval by the
Planning Director.

a. Precise height shall be reviewed at the time of Building
Plan Check, and plans shall be submitted to the
satisfaction of the Building Director.
6. Any satellite dish and/or similar equipment shall comply with
the requirements of Section 1227 of the Zoning Ordinance.
7. Conduit shall be installed in each unit for cable television.
8. Automatic roll-up garage door openers shall be provided.
9. The address of each condominium unit shall be conspicuously
displayed on the front street side of the building with
externally or internally lit numbers.
10. The Final Map shall be recorded prior to the issuance of
building permits unless the Directors of the Planning
Department and the Building Department give prior approval.
11. Two (2) copies of revised plans including site, elevation,
and floor plans shall be submitted for review and approval by
the Planning Director prior to the issuance of any Building
Permit:
a. Plans shal 1 clearly indicate that the minimum amount of
enclosed storage space of 200 cubic feet is available to
each unit, at least 100 cubic feet of which is accessible
to the ground level.
12. An "Acceptance of Conditions" form shall be executed and
submitted to the Planning Department prior to the issuance of
the Building Permits.
13. The Conditional Use Permit shall be null and void two years
from the date of approval unless Building Permits have been
obtained and approval of the Tentative Parcel Map shall
become null and void twenty-four months from the date of
approval unless the final map is finaled. The applicant may
apply in writing for an extension of time to the Planning
Commission prior to the date of expiration.
