A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA
BEACH, CALIFORNIA, APPROVING A REQUEST FOR AN EXCEPTION FROM
SECTION 13-7(B) OF THE ZONING ORDINANCE TO ALLOW AN ADDITION AND
REMODEL TO AN EXISTING NONCONFORMING STRUCTURE TO EXCEED 50% OF
REPLACEMENT VALUE, AND APPROVAL, PURSUANT TO SECTION 13-7(B)3. TO
ALLOW THE CONTINUATION OF AN EXISTING WALL WITH A NONCONFORMING
SIDE YARD AT 576 21ST STREET AND LEGALLY DESCRIBED AS THE
WESTERLY 30 FEET OF LOT 44 AND THE EASTERLY 25 FEET OF LOT 43,
TRACT 1868
WHEREAS, the Planning Commission held a hearing on March 20,
1990, regarding an application for exception, pursuant to Section
13-7(B) 13-7(C)3. to allow more than a 50% addition to a
nonconforming structure and to allow the continuation of an
existing wall with a nonconforming setback and made the following
findings:
A. The applicant is proposing to remodel and expand an existing
single-family structure which results in an addition/remodel
equivalent to 96% of the replacement value of the existing
structure;
B . The dwelling is nonconforming to the side yard setback, and
to the required 17-foot garage setback;
C. The proposed remodel/expansion involves a minor remodel of
the existing first floor and the addition of a second floor;
D. Given that the existing nonconformities are not significant
or exceptional, and that this project would encourage the
long term maintenance of a single-family structure in sound
condition this project is consistent with intent and goals of
the ordinance regarding the remodel of nonconforming
structures.

NOW, THEREFORE, BE IT RESOLVED that the Planning Commission
of the City of Hermosa Beach, California does hereby approve a
request for an exception, pursuant to Section 13-7(B) and Section
13-7(C)3. of the zoning ordinance, to allow more than a 50%
addition and the continuation of a nonconforming sideyard at an
existing nonconforming structures at 576 21st Street.
