HomeMy WebLinkAboutPC Resolution 90-362 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION P.C. 90-36 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA BEACH, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT AMENDMENT AND PARKING PLAN TO ALLOW THE INSTALLATION OF A PORTABLE CLASSROOM IN THE PARKING LOT OF AN EXISTING CHURCH AND SCHOOL LOCATED AT 340 MASSEY AVENUE, LEGALLY DESCRIBED AS LOTS 1-5 INCLUSIVE, LOTS 7 AND 8, AND LOTS 21-40 INCLUSIVE, HERMOSA HEIGHTS TRACT, AND ADOPTION OF A NEGATIVE DECLARATION WHEREAS, the Planning Commission held a public hearing on May 15, 1990, to receive oral and written testimony regarding a request for a conditional use permit amendment and made the following findings: A. The applicant is proposing to use a portion of an existing parking lot for a portable classroom thereby usurping an existing eight parking spaces; B. The church and school facility are currently legally nonconforming to parking since the parking requirements have changed since the facility was constructed; C. The applicant is proposing an attendant supervised valet parking system to accommodate the deficiency of 20 parking spaces which results from application of the current parking requirement in combination with existing parking spaces; the elimination of 8 D. The proposal does not expand the existing approved uses on the site, it is needed to respond to a change in enrollment; E. The proposed use is consistent with the Hermosa Beach General Plan and imposition of conditions as required by this resolution will resolve the created parking deficiency, and will mitigate any residential properties; impacts on nearby commercial and NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Hermosa Beach, California does hereby approve a Conditional Use Permit and Parking Plan to allow the addition of -1 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 a portable classroom at 340 Massey Avenue, subject to the following conditions : 1. The location of structures and features on the property shall be in substantial conformance with submitted plans; any modification shall be submitted to the Planning Director for approval. 2. An attendant shall be available on the premises prior to church services to direct and park cars on the premises when all the available standard parking stalls are filled. The attendant shall be responsible for the parking of no more than 20 cars in excess of the number of parking stalls, and shall park these excess cars on the premises in the locations shown for additional parking on the submitted parking plan. 3. The applicant shall explore the alternative of providing up to 30% of the parking stalls as compact stalls to maximize the number of parking spaces on the site. The final parking layout shall be reviewed and approved by the Planning Director. If the parking requirements of the zoning ordinance can be met through the use of compact stalls and a restriping of the parking lot the requirement for providing a valet parking service shall be unnecessary. 4. The installation of the portable classroom shall conform to all requirements of the Building Department. 5. Prior to the Conditional Use Permit being in effect, the applicant shall submit to the Planning Department, a signed and notarized "Acceptance of Conditions" form. 6. The Conditional Use Permit shall be recorded with the deed, and proof of recordation shall be submitted to the Planning Department. 7. The Planning Commission shall review the Conditional Use Permit within one year to determine if the need still exists for the portable classroom and to assess the progress towards providing additional permanent classroom space to replace the portable structure, and if deemed necessary to amend the Conditional Use Permit to mitigate any detrimental effects on the neighborhood resulting from the subject use.
