RESOLUTION NO. 90-37
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA
BEACH, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT FOR A PARTS
STORAGE FACILITY TO BE OPERATED IN CONJUNCTION WITH EXISTING
VASEK POLAK AUTOMOBILE DEALERSHIPS AT 737 THIRD STREET, LEGALLY
DESCRIBED AS LOT 56 AND 57 AND THE WESTERLY 20 FEET OF LOTS 26,
27, AND 28, WALTER RANSOM CO'S VENABLE TRACT AND ADOPTION OF AN
ENVIRONMENTAL NEGATIVE DECLARATION
WHEREAS, the Planning Commission held a public hearing on May
15, 1990, to receive oral and written testimony regarding a
request for a conditional use permit and made the fol lowing
findings:
A. The applicant is proposing to use the subject location for a
parts storage warehouse in conjunction with existing
automobile dealerships located along Pacific Coast Highway;
B. The proposed use is consistent with the provisions of the
Commercial Corridor Specific Plan Area zone which allows
existing commercial or non-residential uses with frontage on
side streets to be used for commercial purposes;
C. The location is appropriate for the proposed use because of
its proximity to Pacific Coast Highway, and the fact that the
use across the street is a public parking lot;
D. The proposed use is consistent with the Hermosa Beach General
Plan
E. The imposition of conditions as required by this resolution
shall mitigate any impacts on nearby commercial and
residential properties;

NOW, THEREFORE, BE IT RESOLVED that the Planning Commission
of the City of Hermosa Beach, California does hereby approve a
Conditional Use Permit for an automobile parts storage facility
at 737 Pacific Coast Highway, subject to the following
conditions:
1. The location of structures and features on the property shall
be in substantial conformance with submitted plans; any
modification shall be submitted to the Planning Director for
approval.
2. The use of the site shall be for automobile parts storage
only. Auto repair, sales of any type, auto washing, and/ or
storage of vehicles other than those used for parts delivery
shall be prohibited.
3. The public right-of-way shall not be used for delivery or
storage of automobile parts. Deliveries shall be conducted
on the subject property.
4. The parking area shall be used for vehicles used
delivery and pick-up of parts and for employees
dealerships only, storage and parking of vehicles for
any other purpose shall be prohibited.

5. The driving of delivery vehicles on local residential streets
shall be prohibited except for the segment of Third Street
from the subject site to Pacific Coast Highway.
6. All work activities other than the loading and unloading of
parts shall be conducted within the building.
7. The hours of operation shall be limited to the hours between
7:00 a.m. and 6:00 p.m. on weekdays only.
8. Noise emanating from the property shall be within the
limitations prescribed by the City's noise ordinance, Article
19.5 of Hermosa Beach Municipal Code, and shall not create a
nuisance to the surrounding residential neighborhood and
commercial establishments. Creating loud or obnoxious noise
shall be prohibited.
9. There shall be no outdoor bells, buzzers or outside paging
system.
10. The exterior of the premises including the parking areas
shall be maintained in a neat and clean manner at all times.
11. All exterior lights shall be located and oriented in a manner
to prohibit glare to the neighboring residential property and
public right-of-way.

12. The 5-foot wide landscaped strip located along the westerly
property line shall be provided with 6" high raised concrete
curbing and shall be planted with trees which provide the
maximum visual buffer for the adjacent residential use. The
quantity, type and size of trees and landscaping shall be
depicted on a landscape plan to be reviewed and approved by
the Planning Director.

on the plan.
13. Prior to the Conditional Use Permit being in ef feet, the
applicant shall submit to the Planning Department, a signed
and notarized ."Acceptance of Conditions" form.
14. The Conditional Use Permit shall be recorded with the deed,
and proof of recordation shall be submitted to the Planning
Department.
15. The Planning Commission may review the Conditional Use Permit
and may amend the subject conditions or impose any new
conditions if deemed necessary to mitigate detrimental
effects on the neighborhood resulting from the subject use.
