A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA
BEACH, CALIFORNIA, DENYING A VARIANCE REQUEST TO ALLOW PARKING IN
THE FRONT 20 FEET OF A LOT, AN ENCROACHMENT INTO THE FRONT YARD
ON THE STRAND FOR THE ROOF OF AN EXISTING BALCONY , AND DENYING A
VARIANCE FROM SECTION 13-3 (C) OF THE ZONING ORDINANCE FOR A
REDUCTION IN A NONCONFORMING AMOUNT OF OPEN SPACE FOR THE REMODEL
OF A NONCONFORMING USE WHICH EXCEEDS 45 UNITS PER ACRE AT 2634
THE STRAND, LEGALLY DESCRIBED AS LOT 26, BLOCK 27, HERMOSA BEACH
TRACT
WHEREAS, the Planning Commission held a public hearing on May
15, 1990 to receive oral and written testimony regarding an
application for a Variance at 2634 The Strand and made the
following findings:
A. The applicant is proposing to remodel an existing
nonconforming six (6) unit apartment building into five (5)
units and proposes to provide two parking spaces with access
from Hermosa Avenue, and to replace a balcony awning
structure with a roof above the balcony, consistent with the
roof of the structure which all require variances from the
zoning ordinance;
B. The reduction to 5 units would still result in a density of
79 units per acre which significantly exceeds the maximum of
45 units per acre allowed for nonconforming use remodels and
if allowed would add permanence to a significantly overdense
residential property;
C. The property is nonconforming to parking and to density,
among other nonconformities, and although this proposal would
reduce some of these nonconformities, the property would
remain significantly out of conformity with the zoning
ordinance;

D. The provision of 2 off-street parking spaces causes the loss
of one on-street parking space meaning a net gain of only one
space which does not justify the loss of 180 square feet of
open space;
E. There are no exceptional or extraordinary circumstances
related to the physical condition of the property which
justify a variance;
F. Granting the variance request would not preserve a
substantial property right possessed by other properties in
the vicinity or in the same zone;
G. Granting a variance would not be consistent with the Land Use
Element of the General Plan;
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission
of the City of Hermosa Beach, California, does hereby deny a
variance for 2634 The Strand.
