A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA
BEACH, CALIFORNIA, APPROVING A VARIANCE REQUEST TO ALLOW A SECOND
STORY ADDITION TO A NONCONFORMING SINGLE-FAMILY DWELLING WITH A
SUBSTANDARD SIZE PARKING STALL (9 INCHES DEFICIENT) AT 1781
VALLEY PARK AVENUE, LEGALLY DESCRIBED AS LOT 31, TRACT 15546
WHEREAS, the Planning Commission held a public hearing on
July 3, 1990 to receive oral and written testimony regarding an
application for a Variance at 1781 Valley Park Avenue and made
the following findings:
A. The existing garage is sufficient in depth for one parking
space while the second space has a depth of 17 feet, 3
inches, which is deficient by 9 inches;
B. The existing dwelling is also nonconforming to current zoning
requirements because the front yard garage setback is 7 .1
feet and because one sideyard is only 3.21 feet;
C. There are exceptional or extraordinary circumstances related
to the existing structural features of the property that
restrict the applicant's abi 1 i ty to make the garage
conforming, and there is an existing 22 percent lot coverage
with a great deal of open space, and it is desired by the
Commission to maintain the building size and the existing
footprint;
D. Granting the variance request would preserve a substantial
property right possessed by other properties of similar size
and shape in the vicinity and zone of the property;
E. The variance will not be detrimental to neighboring
properties as the garage will still accommodate two average
sized vehicles;
E. The request for continuing the nonconforming sideyard of 3.21
feet for the second story addition cannot be approved because

Section 13-7(c)(3) requires that 75% of the existing houses
on the same block have the same or a smaller nonconforming
sideyard and, at most, only 50% of the structures on the
subject block have equivalent or lesser sideyards.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of
the City of Hermosa Beach, California, does hereby approve a
variance for 1781 Valley Park Avenue subject to the following
conditions:
1. The proposed development shall be in substantial conformance
with submitted plans. Any minor modification shall be
reviewed and approved by the Planning Director.
2. All new portions of the structure shall conform with current
zoning requirements.
3. Further additions or remodels to the existing structure is
prohibited unless all existing nonconformities to current
zoning requirements are eliminated.
