A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA
BEACH, CALIFORNIA, AMENDING A CONDITIONAL USE PERMIT AND PARKING
PLAN FOR THE INSTALLATION OF A PORTABLE CLASSROOM (RESOLUTION
P. C. 90-36) TO ALLOW THE CONSTRUCTION OF 9-FOOT HIGH FENCE TO
REPLACE AN EXISTING 6-FOOT HIGH FENCE AT 340 MASSEY AVENUE,
LEGALLY DESCRIBED AS LOTS 1-5 INCLUSIVE, 7, 8, AND 21-40
INCLUSIVE, HERMOSA HEIGHTS TRACT.
WHEREAS, the Planning Commission held a public bearing on
August 21, 1990, to receive oral and written testimony regarding
a Conditional Use Permit amendment request and made the following
findings:
A. The proposed 9-foot high fence is necessary to mitigate the
potential noise, visual, and safety impact of the school use
being adjacent to residential uses;
B. The greater height wi 11 not be detrimental to neighboring
property or to the public welfare, and will not interfere
with the light, air, and scenic views of any property;
C. The fence wi 11 be constructed of chain 1 ink with aluminum
slats, replacing an existing chain link fence;
D. The proposed fence is appropriate for the subject area and
will be compatible with surrounding uses;
E. Strict compliance with the conditions of approval will
mitigate any negative impact resulting from the issuance of
the Conditional Use Permit and Parking Plan:
NOW, THEREFORE, the City of Hermosa Beach, California does
hereby approve a Conditional Use Permit, to allow a nine (9) foot
high fence at 340 Massey Avenue subject to the following
conditions:
1. Conditions regarding the fence:
a) A building permit shall be obtained for the construction
of the 9-foot high fence;

b) The fence shall be constructed of chain link and shall
include painted aluminum slats.
c) The fence shall be maintained free of rust.
d) The exterior of the premises shall be maintained in a neat
arid clean manner at all time.

b) An attendant shall be available on the premises prior to
church services to direct and park cars on the premises
when all the available standard parking stalls are filled.
The attendant shall be responsible for the parking of no
more than 20 cars in excess of the number of parking
stalls, and shall park these excess cars on the premises
in the locations shown for additional parking on the
submitted parking plan.
c) The applicant shall explore the alternative of providing
up to 30% of th parking stalls as compact stalls to
maximize the number of parking spaces on the site. The
final parking layout shall be reviewed and approved by the
Planning Director. If the parking requirements of the
zoning ordinance can be met through the use of compact
stalls and a re-striping of the parking lot the
requirement for providing a valet parking service shall be
unnecessary.
d) The installation of the portable classroom shall conform
to all requirements of the Building Department.
3. Prior to the conditional use permit being in effect, the
applicant shall submit to the planning department, a signed
and notarized "Acceptance of Conditions" form.
4. The Planning Commission may review the Conditional Use Permit
and Parking Plan and may amend the subject conditions or
impose any new conditions if deemed necessary to mitigate
detrimental effects on the neighborhood resulting from the
subject use.
5. Portions, i.e. the fence and/or temporary classroom, of the
conditional use permit not implemented within two (2) years
shall expire, unless the applicant obtains an extension from
the Planning Commission.
6. This Resolution supersedes P.C. Resolution 90-36
