RESOLUTION P.C. 90-98
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA
BEACH, CALIFORNIA, APPROVING A VARIANCE TO ALLOW A GARAGE SETBACK
OF 16 FEET RATHER THAN THE REQUIRED 17 FEET AND TO ALLOW THE
SUBSTANDARD SETBACK OF 16 FEET TO BE COUNTED AS A GUEST PARKING
SPACE AND ADOPTION OF AN ENVIRONMENTAL NEGATIVE DECLARATION AT
1734 PROSPECT AVENUE, LEGALLY DESCRIBED AS LOT 9, ANGELA HEIGHTS
TRACT
WHEREAS, the Planning Commission held a public hearing on
December 4, 1990 to receive oral and written testimony regarding
an application for a Variance at 1734 Prospect and made the
following findings:
A. The applicant is requesting a variance from the garage
setback requirements to enable him to provide adequate
parking to legalize the ground floor living area, previously
approved by a variance for use by a handicapped relative, as
a second dwelling unit;
B. There are exceptional circumstances related to the topography
of the property which limits the feasibility of expanding the
garage while complying with the required 17 foot setback;
C. The garage is being remodeled in a manner that will maximize
the garage setback at about 16 feet;
D. There is a further exceptional circumstance of the extra wid
right-of-way width of Prospect Avenue which results in th
front property line being 20 feet from the street curb,
meaning that even with the substandard 16-foot setbac
adequate room will be available to support on-site gues
parking;
E. The variance is necessary to preserve a substantial propert
right possessed by other properties in the same vicinity;

F. Granting the variance will not be potentially detrimental t
the public welfare or to adjacent and nearby properties;
G. The granting of the variance is not inconsistent with th
General Plan;
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission o
the City of Hermosa Beach, California, does hereby approve th
requested variance at 1734 Prospect Avenue subject to th
following conditions:
1. The proposed development shall be in substantial conformanc
with submitted plans. Any minor modification shall b
reviewed and approved by the Planning Director.
