The City Council recessed to Closed Session. a)23-0478 MINUTES: Approval of minutes of Closed Session held on July 25, 2023. b)23-0479 CONFERENCE WITH LEGAL COUNSEL: Existing Litigation - Government Code Section 54956.9(d)(1) The City finds, based on advice from legal counsel, that discussion in open session will prejudice the position of the City in the litigation. ANNOUNCEMENTS - UPCOMING CITY EVENTS Mayor Jackson announced the following events - Hermosa Beach Little League will welcome a 14-and-under All-Star team from Japan on August 9 at 11:00 a.m. - Glow Ride for Cystic Fibrosis event on August 12 from 5:00 p.m. to 9:00 p.m. - Fall Paper Shredding and Compost Giveaway Event on September 9 from 8:00 a.m. to 12:00 p.m. - State of the City Address on September 14 at 6:00 p.m. at the Community Theatre - Hermosa Beach Museum Gala on August 26, at St. Cross Church, at 6:00 p.m. VI. APPROVAL OF AGENDA A motion was made by Mayor Pro Tempore Massey, seconded by Councilmember Detoy to continue the Public Hearing item 13a and approve the remaining order of the agenda. The City Council reconvened from recess at 10:55 p.m. City Clerk Maravilla conducted a roll call and announced a quorum. Mayor Jackson asked various questions. Director Tai and Consultant provided information. The City Council continued deliberation on this item. Councilmember Francois provided comments. Mayor Jackson stepped outside at 11:27 p.m. and returned at 11:28 p.m. Councilmember Francois provided additional information. Councilmember Saemann and Mayor Pro Tem Massey recused themselves during the discussion of sites located at 301, 308, and 321 Pier Avenue. The remainder of the City Council voted on these location sites. Mayor Pro Tem Massey returned to the dais. City Attorney Donegan listed additional sites to be discussed and voted on. All members except for Councilmember Saemann conducted a vote. Councilmember Saemann re-entered the chamber and the City Council continued deliberation on this item. A motion was made by Councilmember Francois, seconded by Councilmember Detoy to include sites 3, 4, and 6 located at 301 Pier Avenue, 308 Pier Avenue, and 321 Pier Avenue in the 2021-2029 Housing Element. The motion carried by the following vote: Aye:Mayor Jackson, Francois, and Detoy3 - Absent:0 Recused:Massey, and Saemann2 - A motion was made by Councilmember Detoy, seconded by Mayor Pro Tem Page 8City of Hermosa Beach Printed on 9/13/2023 August 8, 2023City Council Meeting Minutes - Final Massey to include sites 7, 8, 9, and 10 located at 318 Pier Avenue, 321 Pier Avenue, 337 Pier Avenue, 338 Pier Avenue, 400 Pier Avenue, 420 Pier Avenue, 422 Pier Avenue, 506 Pier Avenue, 514 Pier Avenue, 526 Pier Avenue, 1315 Valley Drive, and 552 11th Street in the 2021-2029 Housing Element. The motion carried by the following vote: Aye:Mayor Jackson, Massey, Francois, and Detoy4 - Absent:0 Recused:Saemann1 - A motion was made by Councilmember Saemann, seconded by Councilmember Francois to adopt the Resolution approving the General Plan Amendment 23-01 consisting of revisions to the previously adopted 2021-2029 Housing Element and associated changes to the land use element of the General Plan and determine that the revised Housing Element is exempt from the California Environmental Quality Act, with the following modifications to the Sites Inventory: 1) change the St. Cross property to R2(TBD); 2) add 8-26 Pacific Coast Highway; and 3) add sites 29 and 30 located at 1706/1734 PCH. The motion carried by the following vote: Aye:Mayor Jackson, Massey, Francois, Saemann, and Detoy5 - Absent:0 XIV. MUNICIPAL MATTERS a)REPORT 23-0468 DESIGNATION OF VOTING DELEGATE & ALTERNATE FOR THE LEAGUE OF CALIFORNIA CITIES 2023 ANNUAL CONFERENCE (City Manager Suja Lowenthal) A motion was made by Councilmember Detoy, seconded by Mayor Pro Tempore Massey to extend the meeting to 1:00 a.m. The motion carried by the following vote: Aye:Mayor Jackson, Massey, Francois, Saemann, and Detoy5 - Absent:0 City Manager Lowenthal provided a staff report. No Public Comment was provided. Mayor Pro Tem Massey recommended Mayor Jackson serve as the voting delegate. Mayor Jackson recommended Councilmember Saemann serve as the alternate. The City Council continued deliberations and determined Councilmember Francois would serve as the voting delegate, and Councilmember Saemann as the alternate. A motion was made by Mayor Pro Tempore Massey, seconded by Councilmember Detoy to designate Councilmember Francois to serve as voting delegate and Councilmember Saemann to serve as alternate for the League of California Cities Annual Business Meeting scheduled for Friday, September 22, 2023 in Sacramento, California. The motion carried by the following vote: Aye:Mayor Jackson, Massey, Francois, Saemann, and Detoy5 - Absent:0 XV. FUTURE AGENDA ITEMS a)23-0477 TENTATIVE FUTURE AGENDA ITEMS Mayor Jackson requested a meeting with Verizon to discuss the 5G Cell Tower. XVI.
